What are the responsibilities and job description for the Senior Attorney, RE & Construction Litigation position at Executive Alliance?
A law firm client in Manhattan (short walk from GCS/Penn), with consistently high growth & pipeline, is hiring a Senior Attorney, RE & Construction Litigation and Transactions, a newly-created position due to growth, with a VERY clear and intended path to Partner! Base salary approximately $250k to $350k, possibly more (DOE), plus bonus, 100% firm paid FAMILY medical insurance coverage, origination fees, and 401k. A book of business is a plus but NOT REQUIRED. Fast interview process - ONE meeting with the Partners and done.
The firm specializes in representing owners, developers, architects, engineers, contractors and investors in NYC re Commercial RE & Construction Litigation and Transactions matters, including RPAPL 881 / adjoining property access, construction / engineering / architecture defects, mechanic's liens, project delays, contract disputes, encroachment, etc. The Sr Attorney will have a 'hands on' role, preparing, filing, negotiating, and reviewing legal docs, appearing in court, etc., owning cases from inception to conclusion.
RPAPL 881 Statute Experience: In addition to more broad RE & Construction transactional & litigation experience, you MUST HAVE reasonably strong, ‘hands on’ experience with EITHER:
- Preparing & filing petitions pursuant to RPAPL 881 litigation matters
OR
- Preparing, negotiating, and reviewing license / adjoining property access agreements pursuant to RPAPL 881 transactional matters reflective of the statute's provisions, including scope & duration, license fees, insurance, indemnification, legal fee reimbursement, etc.
If the Senior Attorney does NOT have 'hands on' experience with BOTH RPAPL 881 litigation AND transactional experience, they will be trained in one of the other by the Firm Partners, to help elevate the Senior Attorney's overall RPAPL 881 experience to the expert level.
RPAPL 881 Litigation and Transactional matters will be one of several key focus areas for the Senior Attorney.
Key Responsibilities:
- Own and perform all aspects of commercial RE & construction litigation and transactions from beginning to end
- Draft pleadings, briefs, affidavits, motion and other legal documents / filings (w/ some assistance from the firm’s paralegals)
- RPAPL 881 Litigation AND Transactional work
- Appear in NY courts
- Oversee and help manage a few Associate Attorneys
- Perform legal research, discovery, analyze complex legal matters, prepare legal memoranda
Key Requirements:
- ~5-15 TOTAL yrs of litigation experience, including 3 yrs handling commercial RE & construction litigation cases and transactional matters beginning to end
- Solid, 'hands on' RPAPL 881 experience re litigation OR transactional matters is REQUIRED.
- NY J.D.
- Experience appearing in NY courts, preferably including Supreme Court.
- Analyze and research complex legal matters, perform discovery, prepare appropriate legal documents, and handle client litigation and transactions matters beginning to end
- Strong Contract Law experience
- Strong client relations experience
