Learn more: https://www.enbridge.com/about-us Posting End Date: November 16, 2022 Employee Type: Regular-Full time Union/Non: This is a non-union position Our Associate General Counsel plays a meaningful role in providing proactive and strategic leadership as it relates to the legal and regulatory affairs of Enbridge’s US Gas Transmission & Midstream (GTM) business. Have you been responsible for regulatory and new project initiatives, operational issues, mitigation of legal risks? While in this role you will also be accountable for identifying strategic solutions to enable Enbridge to meet its financial and operational long-range plans while having a continuous focus on compliance with legal and regulatory requirements. What you will do: Assist Senior and Executive Management by providing legal advice, direction, correspondence, guidance and opinions in relation to operational, compliance, environmental, permitting, pipeline safety, and lands matters effecting Enbridge Inc’s US GTM business unit. and its affiliates. Work closely with centralized functions such as Safety & Reliability (Environment and Lands), PACS and External Affairs to provide integrated services in support of the US GTM business, and to represent the US GTM business in Enterprise-wide policy development. Responsible for managing the use of outside counsel on various compliance, permitting and litigation matters and ensuring that they are providing services in an effective and cost-efficient manner and at times negotiating fee arrangements with external counsel. Keep informed and keep relevant management advised on applicable law including pending changes in legislation and regulations affecting US GTM in its affairs and operations. Advising Senior Management regarding the development of regulatory positions the company should take independently or in conjunction with industry associations such as INGAA. Supervise staff of 2-3 attorneys within the Operations, Permitting & Lands team of US Gas Law Collaborating with Senior and Executive Management within GTM and with senior Law Department staff enterprise-wide to provide advice and strategic feedback regarding issues that arise with competitors, partners, landowners, regulators, and politicians. Independently responding to requests from clients for advice on a myriad of legal and regulatory issues involving operations, environmental compliance, pipeline safety, environmental permitting, and project implementation issues. Independently drafting and preparing regulatory pleadings, applications, responses to regulatory enforcements, or opinions, and directing outside counsel on preparation of filings or conduct of regulatory proceedings. Keeping abreast of relevant regulatory initiatives and decisions throughout North America and in other regulated energy industries such as liquids and electric. Interacting with external counsel, senior staff at various regulatory agencies and energy policy makers to advocate Enbridge’s position; acquire support for regulatory strategies, mitigate risk of a complaint, or resolve a conflict. Directing and mentoring legal personnel to ensure appropriate succession opportunities and development of personnel through the assignment of increasingly complex files as appropriate. Representing the Company at a senior level on industry committees and at various industry events as a speaker. Occasional travel to Calgary, Washington, DC, Boston, and other North American destinations as required. Maintain effective communications with all departments seeking advice on legal matters. Who you are: You have: This position requires a well-rounded and experienced operations/compliance/environmental/regulatory Lawyer with a minimum of 10 years of directly relevant experience A J.D. degree with excellent academic credentials, and an active member in good standing of the Bar Association that permits you to practice law in one of the U.S jurisdictions where Enbridge has significant operations. Excellent project management, leadership and partnering skills with the ability to work collaboratively with teams to creatively solve problems while adhering to the company’s values, policies, and procedures You can: Show experience and knowledge in the following areas: Judicial appeals related to permitting matters Advising clients on permitting issues related to FERC certificate proceedings Advising clients on PHMSA Pipeline Safety Regulations and responding to enforcement actions Responding to pipeline incidents and follow up on regulatory investigation and enforcement matters Clean Air Act regulations and permitting with respect to natural gas transmission and storage operations and projects, and responding to enforcement actions Familiarity with other applicable environmental regulations (Clean Water Act, RCRA) Offer sound judgement, ethics and integrity, intuition for business, and decision-making capabilities in dealing with sophisticated legal issues on a global basis. Adapt quickly, prioritize effectively, and have a highly developed level of practicality and business while also possessing a high degree of discretion, tact, and diplomacy in dealing with senior/executive leadership, internal collaborators, and external contacts You are: A self-starter with the ability to work independently and effectively with a wide range of business partners and see projects through to completion An outstanding written and verbal communicator with the ability to clearly connect with all levels (including executive leadership) within the organization Strong in relationship management in which you can develop, influence and nurture trust-based relationships across the organization while also handling highly confidential and sensitive information.
