Position Overview
We are seeking a detail oriented Trusts & Estates Associate Attorney to join our team. As an associate you will handle estate planning, trust and probate administration, tax planning, and elder law matters. Responsibilities include drafting estate documents, managing trust and probate files, preparing court and tax filings, and representing clients in related proceedings. Strong drafting, client counseling, and fiduciary/tax experience are essential. If you have 5 years of experience as a Trust & Estates Attorney and are looking for a role with a clear path for growth.
Key Responsibilities
- Draft and review estate planning documents (revocable and irrevocable trusts, ILITs, wills, powers of attorney, healthcare directives, funding documents).
- Manage probate, estate, and trust administrations, including court filings, accountings, and distributions.
- Advise on estate, gift, and GST tax planning; prepare or coordinate Forms 706 and 1041 and ensure tax compliance.
- Provide Medicaid/elder law planning and asset protection strategies.
- Develop charitable planning structures (CRTs, CLTs, and related vehicles).
- Handle trust modifications, decanting, contested matters, and fiduciary proceedings (guardianships, conservatorships).
- Advise on retirement/IRA beneficiary planning and coordination of retirement assets.
- Conduct due diligence, conflict checks, and asset/title reviews; oversee closings and notarial procedures.
- Communicate complex concepts clearly to clients and advisors; participate in client meetings.
- Collaborate with accountants, financial advisors, and other professionals on integrated estate and tax strategies.
- Manage case files, deadlines, pleadings, correspondence, billing, and records.
- Supervise paralegals and junior staff and contribute to template and process development.
- Support business development, seminars, and referral outreach.
Qualifications
- JD from an accredited law school
- Active bar admission in the state of New Jersey
- 5 years of trusts & estates, probate, and estate planning experience
- Experience drafting revocable and irrevocable trusts, wills, POAs, and healthcare directives.
- Experience with Forms 706, 1041, and estate gift tax compliance.
- Proven probate administration, settlement, and fiduciary accounting experience.
- Knowledge of Medicaid planning, elder law, and asset protection strategies.
- Experience with trust modification decanting, estate litigation, and fiduciary proceedings preferred.
- Ability to manage multiple matters and deadlines in a fast paced environment.
- Proficiency with legal research tools and document/financial management systems; notary preferred.
- Excellent communication and collaborative skills.
- Ability to pass conflicts background checks; ACTEC membership, LL.M. in Tax, or CPA is a plus.
