Position Overview
We are seeking an experienced Trusts & Estates Administration & Litigation Associate to join our firms fiduciary and probate practice. The associate will manage a mixed caseload of trust and estate administration matters, contested probate and trust litigation, and provide counsel to fiduciaries and beneficiaries on estate planning instruments, fiduciary duties, and post-death administration. The ideal candidate combines strong litigation skills with detailed knowledge of trust and estate administration, probate procedure, and fiduciary duty principles to deliver clear, strategic advice and effective courtroom advocacy when necessary.
Key Responsibilities
- Manage trust and estate administration matters including asset marshaling, accountings, creditor claims, distributions, and final estate closings.
- Prepare and review estate planning and administration documents, including trusts, wills, codicils, trust amendments, and related settlement agreements.
- Represent fiduciaries, trustees, executors, beneficiaries, and heirs in contested trust and probate litigation matters such as will contests, trust reformation/clarification, breach of fiduciary duty claims, and surcharge proceedings.
- Draft pleadings, motions, discovery, settlement agreements, and memoranda; handle depositions, evidentiary hearings, mediations, and trial preparation.
- Provide legal advice to clients and fiduciaries regarding fiduciary duties, conflict-of-interest issues, tax considerations, and probate deadlines.
- Coordinate with accountants, appraisers, financial institutions, and other professionals to resolve estate administration issues and to prepare fiduciary accountings and tax filings.
- Manage case files, timelines, and client communications, maintaining meticulous records and providing timely updates to clients and supervising partners.
- Identify opportunities to streamline administration processes, reduce client exposure to litigation, and achieve efficient, cost-effective resolutions through negotiation or alternative dispute resolution.
Qualifications
- Juris Doctor (J.D.) degree from an accredited law school and admission to the state bar in good standing.
- 3 years of litigation experience with a substantial focus on trusts, estates, probate, and fiduciary matters; experience in fiduciary administration is strongly preferred.
- Demonstrated courtroom experience, including drafting pleadings, conducting discovery, taking depositions, and participating in trials or evidentiary hearings.
- Strong knowledge of trust and estate law, probate procedure, fiduciary duty principles, and relevant state statutes and case law.
- Excellent legal writing, analytical reasoning, and oral advocacy skills with the ability to explain complex issues clearly to clients and courts.
- Proven ability to manage a high-volume caseload, prioritize deadlines, and work collaboratively with attorneys, staff, and outside professionals.
- High ethical standards, attention to detail, sound judgment, and a client-focused approach to problem solving.
- Familiarity with estate tax and income tax implications of fiduciary decisions, and proficiency with case management software and e-filing systems.
