Position Overview
We are seeking a Commercial Litigation Associate to join our litigation team and represent businesses, creditors, and other commercial clients in complex disputes. The ideal candidate will handle a broad mix of litigation matters including contract disputes, bankruptcy-related litigation, creditors' rights work, and land use/zoning challenges. This role requires strong courtroom and motion practice skills, excellent client communication, and the ability to manage case strategy from intake through resolution or trial in collaboration with firm partners.

Key Responsibilities

• Manage a docket of commercial litigation matters including contract disputes, breach of fiduciary duty, and shareholder conflicts.
• Draft and file pleadings, motions, discovery requests and responses, and appellate briefs as needed.
• Conduct factual and legal research and prepare memoranda, strategy outlines, and case analyses for partners and clients.
• Prepare for and participate in depositions, hearings, mediations, and trials; coordinate witnesses and exhibits.
• Handle bankruptcy and creditors' rights litigation, including preference actions, lift-stay motions, and claims resolution.
• Advise clients on zoning, land use, and regulatory compliance issues related to commercial disputes and real estate litigation.
• Negotiate settlements, draft settlement agreements, and counsel clients on risk assessment and litigation strategy.
• Work closely with partners and practice groups to develop business opportunities and contribute to client development and retention.
• Manage case budgets, calendaring, and client communications to ensure timely, cost-effective representation.

Qualifications

• Juris Doctor (JD) degree from an accredited law school and admission to the state bar in which the firm practices.
• 2 years of litigation experience with a strong emphasis on commercial litigation; experience in a law firm or appellate/defense environment preferred.
• Demonstrated experience handling contract disputes, commercial litigation, bankruptcy-related matters, and creditors' rights litigation.
• Familiarity with zoning, land use, and real estate-related litigation or administrative proceedings is highly desirable.
• Proven courtroom experience, including depositions, motion practice, hearings, and trial preparation.
• Exceptional legal research and writing skills; ability to draft persuasive motions, briefs, and client correspondence.
• Strong client counseling and negotiation skills with an ability to explain complex legal issues clearly to business clients.
• Ability to manage competing priorities, supervise junior staff, and work collaboratively across teams.
• Professionalism, sound judgment, and strong ethical standards; commitment to business development and contributing to firm growth.
