Summary

To provide effective and independent legal representation as needed for the City of Lubbock, a home-rule municipal corporation and political subdivision of the State of Texas as may be directed by the City Attorney.

Essential Functions

Represents City – Office Practice (60%)
Draft and review contracts, proposed ordinances, resolutions, legal opinions and other legal documents. Correspond and conference with opposing parties and/or attorneys. Communicate with elected and appointed officials of City and City staff regarding legal implications of policy formulation and implementation. Research and analyze federal and state statutes, case law, and administrative regulations as applicable to the question/matter at hand. Represent the City in employee grievances to ensure compliance with federal and state law. Collaborate with other attorneys in the City Attorney’s office.

Offer advice and counsel/meeting representation (30%)
Attend board meetings for City of Lubbock boards and commissions to ensure adherence to Open Meetings requirements and provide advice on parliamentary procedures, due process and applicable laws.

Represents City – Litigation (10%)
Review and craft pleadings, briefs, and other submissions to the courts and administrative agencies. Research and analyze relevant facts and legal positions of City and opposing parties. Research relevant case law and statutory authority in support of City's position. Attend and participate in hearings in state and federal court and before administrative agencies. Supervise City staff responses to discovery inquiry by opposing counsel. Correspond and conference with opposing parties and/or attorneys. Attend and participate in the trial of cases in state and federal courts of law. Prepare and argue appeals in state and federal courts of law.

Qualifications

Completion of a J.D. or L.L.B. degree from an accredited school of law. Licensed to practice law in the State of Texas with five years of legal experience in the practice of law, or any combination of relevant education and experience which provides the following:

Licensed Attorney in the State of Texas
Valid Current Driver's License

Knowledge and Abilities

Knowledge of:


  • Principles and practices of federal, state, and local laws relating to local government, along with legal research methods.
Ability to:
  • Research legal matters quickly and efficiently, including use of computer-aided research;
  • Communicate effectively orally and in writing;
  • Develop and maintain effective working relationships with others;
  • Prepare legal cases and try them in a competent court of law.
Physical Requirements:
  • Frequently lift and carry up to 10 pounds;
  • Occasionally lift and carry up to 25 pounds;
  • Occasionally flex upper trunk forward at the waist and partially at the knees;
  • Place arms above, at, and below should height.
Licenses/Certifications
Required:
  • Licensed Attorney (Texas)
  • Texas Drivers License.
Preferred:
  • Admission to Federal Court (Northern District of Texas)
  • Admission to Fifth Circuit Court of Appeals.
  • Experience in application of City Ordinances of home rule municipalities
  • Experience in state government activities
