The Contract and Compliance Associate (CCA) is responsible for supporting the organization’s commercial, regulatory, and international trade compliance activities. This position reviews and interprets customer and supplier contracts, evaluates products and materials against applicable regulatory requirements, works with suppliers to gather regulatory information, and completes applicable regulatory documents.  This position also performs export classification and trade-compliance reviews.  The CCA must be an ITAR approved person, who is able to review ITAR controlled, EAR controlled, and Controlled Unclassified information (CUI). The CCA supports/drives internal actions required to ensure All Flex compliance with customer requirements, ITAR/export, FAR, DFAR, environmental compliance (RoHS, REACH, TSCA, Conflict Mineral, etc.), and all other contractual obligations.  

 

The Contract and Compliance Associate reports to the Contract and Compliance Manager (CCM), and the position can be based in any of All Flex’s facilities in Northfield, MN or Bloomington, MN with travel between sites as needed.

 

Responsibilities and Duties

Contract Review & Compliance

·       Review customer, supplier, and other contracts or agreements for contractual compliance requirements and business risks.

·       Review of customer flow downs, including Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation (DFAR) clauses.

·       Identify and evaluate provisions related to regulatory compliance, product requirements, certifications, restricted substances, country of origin, export controls, confidentiality, indemnification, liability, and other trade-related obligations.

·       Coordinate with relevant business stakeholders on contract terms requiring clarification, negotiation, or risk mitigation.

·       Maintain records of contract requirements and ensure applicable obligations are communicated to responsible internal functions.

·       Support development and maintenance of standard contractual language, compliance clauses, and customer/supplier certifications.

·       Monitor contractual commitments and assist with ongoing compliance assessments.

 

Regulatory & Product Compliance

·       Review products, components, materials, and supplier information for compliance with applicable environmental and product regulations.

·       Assess requirements associated with regulations and standards such as REACH, RoHS, PFAS, Conflict Minerals/Responsible Minerals, and other applicable substance, material, environmental, or product compliance requirements.

·       Collect, review, and validate supplier declarations, material composition information, certificates, and other compliance documentation.

·       Partner with internal teams (i.e. Engineering, Quality, Purchasing, etc.) to resolve compliance gaps and obtain required documentation.

·       Maintain regulatory compliance records, databases, certifications, and supporting documentation.

·       Assist with customer questionnaires, audits, regulatory inquiries, and compliance reporting.

 

Export Control & Trade Compliance

·       Perform export classification reviews for products, software, technology, components, and related technical information.

·       Determine and document appropriate U.S. export classifications, including ECCN and EAR99, as applicable.

·       Support classification and compliance reviews involving the U.S. Export Administration Regulations (EAR) and other applicable export-control requirements.

·       Review product descriptions, technical specifications, engineering documentation, and other information necessary to support export classifications.

·       Coordinate with Engineering, Product Management, Legal, and other stakeholders to obtain information required for classification determinations.

·       Conduct country, end-user, end-use, and transaction reviews as required by company procedures and applicable regulations.

·       Support denied/restricted-party screening and escalation of potential trade-compliance issues.

·       Maintain classification records and supporting rationale to ensure an appropriate audit trail.

·       Assist with export license determinations and licensing requirements when applicable.

·       Support import/export compliance audits and investigations.

 

Requirements

·       Meets requirements to access ITAR data and information.

·       Bachelor’s degree in Business, Supply Chain, International Trade, Engineering, Compliance, or a related field; equivalent experience may be considered.

·       3–5 years of experience in trade compliance, contracts, regulatory compliance, product compliance, supply chain compliance, or a related field.

·       Working knowledge of U.S. export-control regulations, including the United State Munitions List (USML), the Export Administration Regulations (EAR), Commerce Control List (CCL), and export classification concepts such as ECCN and EAR99.

·       Experience reviewing contracts, compliance clauses, certifications, or other commercial documentation.

·       Familiarity with product/environmental regulations such as REACH, RoHS, PFAS, Conflict Minerals/Responsible Minerals, and related requirements.

·       Strong analytical and research skills with the ability to interpret regulatory and contractual requirements.

·       Excellent written and verbal communication skills.

·       Strong attention to detail and ability to maintain accurate compliance documentation.

·       Ability to work effectively across Legal, Engineering, Procurement, Quality, Sales, Supply Chain, and Operations.

 

Preferred Qualifications

  • Experience performing export classification determinations for products, components, software, or technology.

·       Experience with HTS classification and/or import compliance.

·       Experience with restricted-party screening.

·       Familiarity with ITAR, OFAC, and other U.S. trade-control requirements.

·       Experience with supplier compliance programs and material declarations.

·       Experience using compliance-management, ERP, PLM, or supply-chain systems.

·       Professional certification such as CGBP, CCS, CES, or other trade/compliance certification is a plus.

 

Working Conditions

1.0        

·       Work is indoors in a climate-controlled office or in the production area.  Visits to customers/suppliers may be required on occasion which may involve travel by auto and use of a company vehicle.

·       Work or presence on the plant floor may create exposure to possible hazardous conditions.  Proper safety equipment is provided, and its use is mandatory.

·       Perform quality work within deadlines with or without direct supervision.

·       Gives advance notice of days away from work and keeps unscheduled absences to a minimum.

·       Complete work independently while understanding the necessity for communicating and coordinating work efforts with other co-workers and management.

 

We offer a competitive base salary in the $75,000 to $95,000 range, based on experience and qualifications, along with annual bonus and profit-sharing opportunities tied to performance.
