Key Responsibilities:
FMC is looking for an experienced, pragmatic, and self-starting Employment Counsel, to provide legal support to the Human Resources function and others on labor and employment matters. This role reports to an Assistant General Counsel, in the FMC Law Department, and is based at FMC's global headquarters in Philadelphia, Pennsylvania. Additional detail as follows:

  • Partner with Human Resources and others to provide practical, hands-on legal advice, on a range of labor and employment topics, in the context of day-to-day business, special projects, and the resolution of unique issues that may arise in union, employee, and/or contractor relationships.
  • Serve as the primary lawyer for HR on most labor and employment matters in North America, including labor relations at U.S. manufacturing facilities. Support HR in LATAM, EMEA and APAC on an ad-hoc basis, as assigned.
  • Partner with in-house and external litigation counsel and paralegals to manage employment litigation, labor arbitrations, and other disputes.
  • Proactively monitor and advise HR on key legal/regulatory changes or other risks in the labor and employment space that could impact FMC's business and people, particularly in North America.
  • Advise on global HR-related continuous improvement initiatives, including, for example: create and maintain HR-related policies, procedures, and contract templates; support HR-related process improvements and system changes; advise on onboarding, offboarding, and other employee lifecycle processes; etc.
  • Support the FMC Ethics Office on ethics and compliance matters, including, for example: reviewing training materials and other E&C communications, advising on FMC's whistleblower/internal reporting system and program, monitoring trends, leading/supporting internal investigations, resolving complaints, and debriefing management.
  • Develop and deliver live compliance training on labor and employment topics.
  • Identify and seek to mitigate labor and employment-related legal risks generally, showing good judgment re: when and how to escalate concerns, trends, and/or recommendations for continuous improvement activities to Law Department and/or HR leadership.
  • Participate in and/or lead ad-hoc legal and compliance projects.
  • Effectively manage outside counsel and related budgets, as assigned.
  • Effectively maintain matter records and files.
  • Other work as assigned.

Summary of Key Elements:

  • Member of FMC's Law Department, supporting FMC's global HR strategy across multiple regions
  • Serve as the primary lawyer for the Human Resources (HR) function on most labor and employment matters in North America
  • Report to an FMC Assistant General Counsel, at FMC's global headquarters in Philadelphia, PA

Qualifications:

  • JD from an accredited law school and license to practice law in Pennsylvania
  • 5 - 8 years of relevant, hands-on legal experience in a private law firm or in-house legal department
  • Ability to travel domestically and/or internationally, if/when needed
  • Experience:
    • Exposure to corporate Human Resources functions and the practices of global HR management
    • Experience with global/multi-national organizations preferred
    • Working knowledge of U.S. state and federal labor and employment laws, as well as HR practices and principles, relating to labor relations, collective bargaining, wage/hour laws, workmen's compensation, employee onboarding, DEI, immigration, benefits, discrimination, retaliation, sexual harassment, internal investigations, employee complaints, employee discipline, wrongful termination, reductions in force, severance, releases. ADA, Title VII, FMLA, FLSA, OFCCP, WARN Act, NLRA, ERISA, etc.
    • Practical experience with whistleblower/hotline programs and leading internal investigations
    • Practical experience with the administrative agencies and courts that regulate the employment environment in the United States. Similar experience in Puerto Rico and Canada a plus.
    • Working knowledge of U.S. and international data privacy and cybersecurity laws also a plus
