Job Description

Job Description

The Cooke County Attorney Investigator reviews cases presented to the County Attorney's Office and performs subsequent investigation prior to and after filing cases with the County Court at Law. The Investigator will interview witnesses, serve subpoenas, and performs other duties as assigned.

Certification as a Peace Officer in the State of Texas is mandatory. This position requires a minimum of ten years law enforcement experience; with certification commensurate with that experience. A Bachelor's degree in a law enforcement course of study is preferred.

Excellent inter personal skills, high competence in written and oral communication skills, the ability to pay close attention to detail and carefully scrutinize materials submitted for review from law enforcement agencies, forensic facilities and witness statements, a sophisticated working knowledge of the Texas Code of Criminal Procedure and the Texas Penal Code, familiarity with criminal sanctions available in other statutory areas, and impeccable integrity are required.

Must never have been convicted of any family violence offense. Must not be convicted of an offense above the level of Class B Misdemeanor in the last 10 years. Must not have been discharged from the Military with a Bad Conduct or Dishonorable Discharge.

Must be able to pass the Texas Commission mandated Physical and Psychological requirements.

Tex. Gov't Code 41.109 Authority of Investigator

(a) An investigator appointed by a prosecuting attorney has the same authority as the sheriff of the county to make arrests anywhere in the county and to serve anywhere in the state warrants, capiases, subpoenas in criminal cases, and all other processes in civil or criminal cases issued by a district court, county court, or justice court of this state.

(b) An investigator is under the exclusive authority and direction of the prosecuting attorney and is not under the authority and direction of the sheriff. The prosecuting attorney is responsible for the official acts of his investigators and has the same remedies against his investigators and their sureties as any person has against a prosecuting attorney and his sureties.

(c) An investigator may not draw a fee of any character for performing a duty prescribed by this section.

This position is funded by an annual grant from the State of Texas that must be annually approved.
