PURPOSE OF CLASSIFICATION

At the discretion of the Wood County Prosecutor, the Assistant Prosecuting Attorney is responsible for performing any and all duties required of the Prosecutor, as set forth by the Constitution of the State of Ohio, and is subject to the same qualifications, statutes, requirements, penalties and obligations applicable therein. 



ESSENTIAL FUNCTIONS

The following duties are normal for this position. These are not to be construed as exclusive or all-inclusive. Other duties may be required and assigned.


Ensures departmental compliance with all applicable codes, laws, rules, regulations; standards, policies and procedures; initiates any actions necessary to correct deviations or violations.


Represents the State of Ohio in all Court proceedings including arraignments, dispositions, petitions for revocation, sentencing hearings, bond reductions, appellate hearings, Grand Jury presentments, etc.; prepares motions, briefs,

and other Court documents.


Reviews case files to determine appropriate charges; interviews law enforcement personnel and reviews pending investigations to decide whether or not to bring charges; reviews public complaints.


Prepares documents and presents evidence at hearings for search warrants.


Tries jury, pre-trial, and bench trials.


Trains, advises, educates, and coordinates with law enforcement as to criminal investigations; reviews probable cause affidavits prepared by law enforcement.


Prepares for trials Which includes examining documents and State's evidence, interviewing and preparing witnesses, meeting with law enforcement officers, researching legal issues, etc.; consults and advises victims and police personnel; consults with other departments/agencies regarding cases.


Participates in plea negotiations and prepares pleas agreements.


Maintains files and filing system.


Attends numerous meetings, seminars, workshops, etc, for continuing education purposes.

Data Utilization: Requires the ability to synthesize, hypothesize, and/or theorize concerning data involving modification of existing policies, strategies and/or methods to meet unique or unusual conditions. Requires the ability to do so within the context of existing organizational theories and management principles.


Human Interaction: Requires the ability to function in a managerial capacity for a division or organizational unit. Includes the ability to make decisions on procedural and technical levels.


Equipment, Machinery, Tools, and Materials Utilization: Requires the ability to operate and control the actions of

Equipment, machinery, tools and/or materials requiring complex and rapid adjustments.


Verbal Aptitude: Requires the ability to utilize consulting and advisory data and information, as well as reference, descriptive and/or design data and information as applicable.


Mathematical Aptitude: Requires the ability to perform addition, subtraction, multiplication and division; ability to calculate decimals and percentages; may include ability to perform mathematical operations with fractions; may include ability to compute discount, interest, profit and loss, ratio and proportion; may include ability to calculate surface areas, volumes, weights, and measures.


Functional Reasoning: Requires the ability to apply principals of logical or synthesis functions; to deal with several concrete and abstract variables; and to analyze major problems that require complex planning for interrelated activities that can span one or several work units.


Situational Reasoning: Requires the ability to exercise judgment, decisiveness and creativity in critical and/or unexpected situations involving moderate risk to the organization.


Physical Ability: Tasks require the ability to exert light physical effort in sedentary to light work, but which may involve some lifting, carrying, pushing and/or pulling of objects and materials of light weight (5-10 pounds). Tasks may involve extended periods of time at a keyboard or work station,


Sensory Requirements: Some tasks require the ability to perceive find discriminate colors of shades of colors, sounds, taste, odor, depth, texture, and visual cues or signals. Some tasks require the ability to communicate orally.


Environmental Factors: Essential functions are regularly performed without exposure 10 adverse environmental conditions.

QUALIFICATIONS

  • Bachelor's degree and Juris Doctoral degree
  • plus passing of the Ohio Bar examination supplemented by some relevant experience In trial litigation;
  • or any equivalent combination of education, training, and experience which provides the requisite knowledge, skills, and abilities for this job.
