SCOPE:
We are seeking an experienced Bodily Injury and Property Damage Attorney with a background in automobile insurance to join our team. This hybrid position requires the candidate to handle both Bodily Injury and Property Damage lawsuits including all aspects of case management, discovery, trial preparation from inception through resolution. Additionally, you will work closely with the claims department to ensure legal compliance, mitigate risk, and negotiate settlements. Your role will involve staying current on Florida insurance laws, advising internal teams, and actively participating in mediation, arbitration, and settlement discussions to protect the company’s interests. This position offers a remote work arrangement, allowing the ideal candidate to work from their preferred location within the Miami or Dade County area.
DUTIES:
- Develop case strategies, draft pleadings, motions, discovery, and attend depositions, mediations, hearings, and trials.
- Advise on legal risk related to policy interpretations, claims settlements, and potential exposure.
- Familiar Civil Remedy Notices (CRN), Proposal for Settlements (PFS), Bad Faith.
- Provide strategic recommendations throughout trials, negotiations, mediations, depositions, and roundtable case reviews as needed.
- Stay current with changes in insurance and property damage laws in Florida, ensuring the company is compliant with local, state, and federal laws.
- Collaborate with the claims department, adjusters, and other legal teams to provide proactive and responsive legal support.
- Communicate complex legal concepts and strategies to non-legal personnel clearly and effectively.
- Experience reviewing medical files, police reports, determining liability.
- 30% BI and 70% PD for the BI position.
Qualifications:
- Juris Doctor (JD) from an accredited law school.
- Admission to the Florida Bar and good standing.
- Bilingual in English and Spanish is highly desirable.
- Strong understanding of insurance laws and regulations.
- Ability to analyze complex legal issues and develop effective strategies.
- Proficient in legal research tools and case management software.
SKILLS & EXPERIENCE:
- Minimum of 3-5 years of years of experience in automobile insurnace bodily injury claims litigation.
- Minimum of 3-5 years of experience in automobile insurnace property damage claims and litigation.
- Strong litigation experience with trial skills preferred.
- Excellent negotiation, oral advocacy, and legal writing skills.
- Ability to handle a high volume of cases and prioritize effectively.
- Proficiency in case management software, legal research tools, and Microsoft Office.
