Summit County, located in Utah, is recruiting a civil attorney looking to learn and make a difference among a team of excellent civil attorneys. This opening is advertised as a result of Governor Spencer Cox’s appointment of Ryan P.C. Stack to the Fourth District Court bench. The appointment is still subject to Senate Confirmation, and any applicant’s selection will be contingent upon Mr. Stack’s ultimate approval by the Utah State Senate.
This position will work in our Civil Division, located at the Summit County Courthouse in Coalville, Utah. The successful candidate will join a team focused on providing excellent legal services to county government and our special service districts.
Will perform research and prepare opinions on various legal problems and issues in civil litigation of the county and its special service districts; prepares and approves appropriate charges to enforce county ordinances; prepares for court by performing legal research, composing and drafting briefs, gathering and analyzing evidence and participates in discovery; delivers the county’s or special service district’s case in civil and code enforcement proceedings; attends and participates in motions practice, civil trials and other hearings as required by the court. May hire a Civil Attorney III or IV depending on submitted qualifications and experience. We are a drug free workplace conducting pre-employment drug testing. SALARY
- Civil Attorney III, IV- $119,600.71 - $188,355.59/ annually - see attached (full job descriptions)
MINIMUN QUALIFICATION:
- Graduation from a College of Law with a Juris Doctorate degree; AND
- Five (5) years of experience related to the above duties.
- Must be licensed to practice law in the State of Utah (member in good standing of the Utah State Bar and Federal Bar of Utah).
- Incumbent must successfully complete mandatory Continuing Legal Education (CLE) training every two (2) years.
- Must be able to pass extensive background check.

ESSENTIAL FUNCTIONS
- May attend County Council meeting and department head meetings; advises, counsels and consults with various departments and agencies of the county; assists in the drafting of ordinances for consideration by the County Council.
- Attends and participates in public meetings as needed to serve as a resource and legal voice of the county; apprizes county officers regarding various legal issues related to statutes, ordinances, policies and practices.
- Informs individual citizens concerning various codes or ordinances and responds to their inquiries regarding legal issues.
- Investigates and gives opinion as to the validity of claims against the county; negotiates with persons in the private sector on legal issues pertaining to county government; provides legal advice to Sheriff’s Office as directed; provides legal advice to law enforcement agencies within the county as requested.
- Manages personal caseload assignments and projects; coordinates and cooperates with various county, city, state and federal agencies on special assignments.
- Performs research and prepares opinions on various legal problems of the county and issues in civil cases being prosecuted or defended; prepares and litigates cases arising out of civil activities; interviews witnesses; determines, prepares and approves appropriate charges to enforce county ordinances; prepares for court by performing legal research, composing and drafting briefs, gathering and analyzing evidence and participates in discovery; delivers the county's case in civil and code enforcement proceedings; attends and participates in motions practice, civil trials and other hearings as required by the court.
- Prepares writs, subpoenas, warrants, petitions, affidavits, and other legal documents; may assist Chief Civil Deputy County Attorney in advising county officials on legal matters; submits regular reports, written or verbal to apprize Chief Civil Deputy County Attorney of status of assigned cases.
- Receives, reviews and screens reports and intake activities on code enforcement cases from agencies within the county; assures proper legal procedures and processes are adhered to; determines quality of case and eligibility for filing to pursue legal action.
