Qualifications

Education and Experience: A person in this position must possess a Doctor of Jurisprudence degree, a license to practice law issued by any state, and a valid driver's license. Any applicant who has been disbarred from the practice of law will not be considered.

Overview

Under general direction, an incumbent within this classification serves people who are legally interested in a case and who are dissatisfied with an Agency Decision have a constitutionally-protected right to file an appeal from that decision. When an appeal is filed, unemployment hearing officer conducts a hearing wherein hearing participants are placed under oath, parties are allowed to examine his/her own witnesses, and cross-examine opposing parties and his/her witnesses, admits tangible things into evidence, and builds the record that often serves as the sole basis for judicial review. After conducting a hearing, the unemployment hearing officer issues a written decision wherein express findings of fact are made, and legal conclusions of law are drawn from those facts. This classification is different than the Unemployment Hearing Officer 1 classification in that the person in this classification will also preside over more complex appeals. This classification differs from the Unemployment Hearing Officer 3 in that the person in this position will also have to review an unemployment hearing officer's work and verify that the work was performed pursuant to federal and state requirements. The person in this position may also be called upon to preside over unemployment appeal hearings.

Responsibilities

• The unemployment hearing officer in this classification would be responsible for staying current with relevant federal and statutes; case law; rules and regulations; and the Employment Security Division's policies and procedures.
• Before conducting a hearing, the unemployment hearing officer would prepare for the hearing by reviewing the material in an electronic case file and all applicable laws.
• The unemployment hearing officer will call a hearing to order, identify the participants in the hearing, explain the hearing procedures to them, administer the oath to the hearing participants, ensure that the hearing progresses by only allowing legally relevant evidence to be presented in the hearing, and ensure that all parties' due process rights to be heard are fully protected.
• After conducting the hearing, the unemployment hearing officer will write a grammatically correct decision that makes express findings of fact and draws legally supportable conclusions of law from those facts. The unemployment hearing officer will then determine whether the Agency Decision that is under appeal should be affirmed, modified, or set aside.
• The unemployment hearing officer may be called upon to train other unemployment hearing officers and perform other duties as may from time to time be needed.
