JOB SUMMARY:

The purpose of the Compliance Officer job is to ensure the district's compliance with, and the prompt and equitable resolution of, all complaints pursuant to Title IX, all applicable federal and state laws, and board policies and district administrative procedures prohibiting discrimination, harassment, bullying, and retaliation.   

 

As the primary investigator for the district, the Compliance Officer will review, investigate, make determinations of board policy/district administrative procedure violations, prepare reports, and provide appropriate recommendations related to compliance issues. This position will report to the District’s General Counsel (Cabinet member to the SLCSD Superintendent). 

 

MINIMUM REQUIRED QUALIFICATIONS:

All positions require selected candidates to be fingerprinted and successfully pass a criminal background check. Additional minimum required qualifications for this position are: 

  1. Bachelor's degree from an accredited higher education institution in a related field
  2. Minimum of 2 years direct fulltime paid experience investigating and making determinations on employment/employee complaints
  3. Demonstrated ability to write investigative findings and/or technical employment documents
  4. Professional communication skills including, but not limited to: excellent written and verbal communication skills in English; confident, articulate, and professional speaking abilities; and empathic listening and persuasive speaking skills.
  5. A valid driver’s license and evidence of insurability

PREFERRED QUALIFICATIONS:

  1. Master's degree from an accredited higher education institution in related field
  2. Jurisprudence Doctorate
  3. Experience interviewing minors in an investigative role
  4. One (1) year direct full-time paid experience in administration of governmental regulatory or compliance programs, such as discrimination, harassment, Title IX, workplace abusive behavior, etc.
  5. Demonstrated ability to read, understand and apply complex legal documents, such as: federal and state government employment regulations, ADA, FMLA, Title IX, etc.
  6. Demonstrated ability to train others: develop, deliver and assess efficacy of training events and training materials related to employment compliance issues
  7. Ability to communicate effectively and persuasively; negotiate/mediate solutions to relevant issues to the mutual benefit of all parties involved while adhering to the district’s policies and procedures and contractual requirements
  8. Ability to professionally interact with federal and state agencies, including Office for Civil Rights, Risk Management, and Utah Antidiscrimination and Labor Division
  9. Ability to create, publish, maintain and train on policy and procedures relevant to job responsibilities
  10. Knowledgeable of appropriate employment complaint interview practices
  11. Documentation and compliance skills
  12. Produce periodic and timely status, procedural and/or statistical reports
  13. Ability to develop and maintain effective working relationships with district leadership; maintain a high level of confidentiality; develop and maintain trust in process and procedures
  14. Excellent critical thinking, decision making and organizational skills
  15. Spanish Speaker: speaks, reads, writes and understands spoken Spanish

ESSENTIAL FUNCTIONS & RESPONSIBILITIES:

  1. Collaborates and consult with General Counsel to monitor and manage Title IX type incidents to ensure compliance and efficient and effective responses. Provide periodic and timely updates regarding the status of all pending reports and formal and informal investigations for maintaining compliance within the District.
  2. Attend appropriate IX training to ensure adherence with federal law.
  3. Responsible to oversee prevention efforts to avoid civil rights violations from occurring.
  4. Provide ethical, courteous educational leadership in employment activities.
  5. Serve as a resource for administrators and district and school staff about Title IX and sexual harassment claims.
  6. Screen complaints and interview parties involved to assist in negotiating solutions to relevant issues while coordinating with other administrators, district personnel, students, and federal and state agencies. 
  7. Conduct and document all steps of individual complaint/interview processes pursuant to alleged violations of federal and/or state law, or board policies and district administrative procedures related to discrimination, harassment, bullying, or retaliation for the purposes of ensuring that rights and procedures are adhered to for maintaining integrity in the process.
  8. Create a comprehensive written investigative report for district leadership that clearly identifies the issues investigated, summarizes the evidence, correlates the findings with Title IX, federal and state laws, and board policies and district administrative procedures, and recommends appropriate steps for the purpose of finalizing processes.
  9. Maintain professional workplace etiquette and represent the department/district in a professional manner; maintain confidentiality; observe FERPA and other student privacy laws.
  10. Develop and implement compliance training programs for district employees/stakeholders.
  11. Develop and maintain a thorough understanding of Title IX, federal and state laws related to discrimination, harassment, bullying, and retaliation (e.g. EEO issues, labor laws, regulations, proposed legislation, etc.), and all board policies and district administrative procedures for the purpose of staying up to date on changes.
  12. Advise the district on relevant board policies, district administrative procedures, and practices and coordinate revisions to ensure these documents and practices are up to date and consistent with current requirements under state and federal laws, regulations, and guidelines.
  13. Facilitate the implementation of the district’s policies and procedures related to discrimination, harassment, sexual harassment, retaliation, bullying, cyber-bullying, hazing, and abusive conduct, and ensure that they are applied consistently across the district and at each school site.
  14. Advise General Counsel regarding the status of the district’s compliance with state and federal discrimination laws.
  15. Ensures a well-documented, complaint investigative process by maintaining accurate and thorough records and notes of the entire investigatory process.
  16. Establishes effective working relationships with district leadership to share relevant information, resolve issues as they arise, and foster a culture of inclusiveness for the purpose of collaboration.
  17. Maintains professionalism and a high level of confidentiality for the purpose of ensuring trust and confidence for the procedures related to this job.
  18. Perform multiple, highly complex, technical tasks and routinely upgrade related skills.
  19. Respond to requests for information, clarification, or assistance by applying and interpreting applicable laws, rules, policies, and procedures, and providing training when appropriate for maintaining consistent practices in the District.
  20. Respond to inquiries from students, parents, staff, administrators, and others regarding Title IX, sex discrimination, and sexual harassment.
  21. Maintain regular and predictable attendance for fulfilling job requirements efficiently and effectively.
  22. Provide well-developed interview, research, and analytical skills; judgment and reasoning skills to assess complex information gathered and credibility of persons interviewed; excellent listening and oral communication skills necessary to conduct face-to-face and in person inquiries; conflict resolution and facilitation skills.
  23. Occassionally provide professional presentations and/or training using professional level presentation and public speaking skills. 
  24. Perform basic math, including calculations using fractions, percentages, and/or ratios; review and interpret highly technical information, write technical materials, and/or speak persuasively to implement desired actions; and analyze situations to define issues and draw conclusions. 
  25. Specific knowledge-based competencies required to satisfactorily perform the functions of the job include concepts of grammar and punctuation; board policies and district administrative procedures; issues relating to Title IX, discrimination, harassment, bullying, and retaliation; applicable laws and government regulations; and understanding of computer programs and editing features. 
  26. Schedule a significant number of activities, meetings, and/or events; routinely gather, collate, and/or classify data; and use basic, job-related equipment. Flexibility is required to independently work with others in a wide variety of circumstances; work with data utilizing defined but different processes; and operate equipment using defined methods.
  27. Work with diverse individuals and/or groups; work with data of widely varied types and/or purposes; and utilize specific, job-related equipment. Independent problem solving is required to analyze issues and create action plans. Problem solving with data requires analysis based on organizational objectives; and problem solving with equipment is limited. Specific ability-based competencies required to satisfactorily perform the functions of the job include adapting to changing work priorities; communicating with diverse groups; setting priorities; building collaborative relationships; and working with constant interruptions.
  28. Work under limited supervision following standardized practices and/or methods; providing information and/or advising others; operating within a defined budget; and utilization of significant resources from other work units is sometimes required to perform the job's functions.   30. Perform other related duties as assigned to ensure the efficient and effective operations of the department.

 

WORK ENVIRONMENT:

  1. Travel to school district buildings and professional meetings as required. 
  2. The usual and customary methods of performing the job's functions require the following physical demands: some lifting, carrying, pushing, and/or pulling, and some fine finger dexterity. Generally, the job requires 85% sitting, 5% walking, and 10% standing. 
  3. Risks found in the typical work environment, which is adequately lighted, heated and ventilated, e.g., safe use of office equipment, avoiding trips and falls, observing fire regulations.
