Duties Description

  • Manage office staff, general oversight of administrative procedures, work schedules, and other administrative matters.
  • Review hearing decisions and files to ensure that the due process rights of both sides at hearings are safeguarded, and issue orders, including Final Determinations.
  • Review and monitor hearing decisions of all assigned staff for legal sufficiency and adherence to agency policy and procedures.
  • Ensure that findings are based on facts and decisions are clear, concise, and timely.
  • Keep up-to-date on amendments in statutes, regulations and decisional law; and communicate such changes to staff.
  • Recommend changes to policies and procedures, statutes and/or regulations to management.
  • Handle complaints, including fact gathering, concerning subordinate staff from appellants, appellants representatives and agency representatives.
  • Review requests to vacate determinations, adjournments and for reconsideration and make proper recommendations and/or determinations.
  • Conduct hearings, including the most difficult and precedent setting cases, and court ordered re-hearings.


Minimum Qualifications

Current NYS Justice Center for Protection of People with Special Needs employees with permanent, contingent-permanent or 55b/c service as a Supervising Hearing Officer and interested in reassignment; OR current New York State employees with one year or more permanent, contingent-permanent or 55b/c service as a Supervising Hearing Officer; OR current New York State employees with one year or more permanent, contingent-permanent or 55b/c service in a position allocated to a Grade 25 and above designated administrative and eligible for transfer under Section 52.6 of the Civil Service Law*.

Note: *Admission to the New York State Bar is required.

Non-Competitive Promotion (52.7): If there are no more than three qualified candidates in the promotion field for this position, the agency will request approval from the Department of Civil Service to fill this position via a noncompetitive promotion (NCP) examination, pursuant to Section 52.7 of the Civil Service Law. In order to be eligible for the NCP, candidates must be in the direct promotion field, and must not have failed, or failed to take the last holding of the promotion examination for the title listed above.
