Employment Contract
This Employment Contract ("Contract") is made effective as of October 01, 2024, by and between MJM Logistics, LLC ("Employer") of 1410 Lancaster Road, Chillicothe, Ohio, 45601 and
_______________________ ("Employee") of _______________________,
______________________, _______________________, _________________.
A. The Employer is engaged in the business of logistics, storage, and transportation. The Employee will primarily perform the job duties at the following location: 1410 Lancaster Road, Chillicothe, Ohio 45601.
B. The Employer desires to have the services of the Employee.
C. The Employee is an at-will employee of the Employer. Either party is able to terminate the Contract at any time.
Therefore, the parties agree as follows:
1. Employment. The Employer shall employ the Employee as a(n) Operations Coordinator. The Employee accepts and agrees to such employment, and agrees to be subject to the general supervision, advice, and direction of the Employer and the Employers supervisory personnel. The Employee shall provide to the Employer the following services:
· Certification for Operating a Fork Truck: Training for certification will be provided on site by MJM Logistics, LLC staff.
· Operational Management: Oversee daily operations of all buildings, ensuring efficient and effective processes for receiving, storing, and distributing goods.
· Work Directly with Complex Management Staff and Company Ownership: The Operations Supervisor will work with Complex Management Staff, will work under the direction of Company Ownership, and will be expected to adhere to all directives given to best ensure the company is safe, efficient, and profitable.
· Work Directly with Unit Managers: For organizational and personnel matters related specially to the operations of the entire MJM, Logistics, LLC complex, organization, and individual buildings as needed.
· Leadership and Supervision: Manage and lead warehouse leadership and staff, including training, performance evaluation, probationary periods, and disciplinary actions. Foster a positive work environment and encourage teamwork.
· Evaluations: Perform Annual and As Needed Evaluations of Unit Managers. Review annually and as needed evaluations from Unit Managers of Unit Leads, Material Handlers, Subassembly Worker, Truck Drivers, and any additional positions hired per building within the complex.
· Implement and Oversee Improvement Plans for Employees: Write, implement, and evaluate improvement plans for any employees that necessitate an improvement plan to improve work and/or safety performance.
· Oversee the Probationary Period of New Employees: 60 days for all new company employees that can extend to 120 days if the unit manager deems it necessary.
o Probationary periods can also be instituted for any employees due to disciplinary action or work-related incidents such as accidents and the Operations Supervisor is to oversee the implementation of these plans as well.
· Performance Monitoring: Track and analyze key performance indicators related to warehouse operations, such as order accuracy, fulfillment times, and inventory turnover. Use data to identify areas for improvement and implement corrective actions.
· Strategic Planning: Develop and implement strategies to optimize warehouse operations, including layout design, process improvements, and workflow management.
· Operational Efficiency: Ensure that warehouse operations are efficient, organized, and meet company standards. Implement and monitor procedures to optimize productivity.
· Inventory Control: Maintain accurate inventory records, conduct regular stock checks, and ensure inventory levels are properly managed.
· Quality Assurance: Monitor the quality of goods received and shipped, ensuring they meet company standards and customer expectations.
· Safety Compliance: Follow all safety protocols and guidelines to prevent accidents and injuries.
· Warehouse Organization: Maintain organized storage areas to optimize space and facilitate efficient material handling.
· Problem Solving: Address and resolve issues related to warehouse operations, such as equipment malfunctions, inventory discrepancies, and personnel conflicts.
· Documentation: Complete necessary paperwork, such as delivery receipts and inventory logs, accurately and promptly.
· Reporting: Generate and analyze reports on warehouse performance, inventory levels, and other key metrics. Present findings to unit manager and senior management. Suggest improvements if needed or necessary.
· Resource Management: Manage warehouse resources, including equipment, tools, and supplies, ensuring they are maintained and available when needed.
· Budget Management: Develop and manage the warehouse budget, including cost control and financial reporting. Identify cost-saving opportunities and implement measures to improve financial performance.
· Customer Service: Handle customer inquiries and complaints related to warehouse operations, ensuring timely and satisfactory resolution.
· Continuous Improvement: Identify areas for improvement in warehouse processes and implement changes to enhance efficiency and effectiveness.
· Team Coordination: Collaborate with other warehouse staff and departments within MJM Logistics, LLC to ensure smooth and professional operations and timely material movement.
· Emergency Management: Develop and implement contingency plans to address potential disruptions in warehouse operations, such as natural disasters, equipment failure, or supply chain issues.
· Other Duties as Assigned.
This list of services or job responsibilities is not comprehensive and assigned duties will not be limited to this list. “Other Duties as “Assigned” will be an important piece of employment at MJM Logistics, LLC as this allows management the flexibility to assign staff as needed to important projects outside of the job duties listed.
The Employee shall also perform (i) such other duties as are customarily performed by an employee in a similar position, and (ii) such other and unrelated services and duties as may be assigned to the Employee from time to time by the Employer.
Daily Expectations: EVERY DAY DO THESE THINGS:
· Beginning of Shift Meetings:
o Upon reporting to work at the start of your shift meet with each building manager either collectively or individually (this decision is at the discretion of the Operations Coordinator) at the complex management office to provide daily shift-based instructions from complex management (Operations Coordinator).
§ Unit Managers are required after clocking in to report directly to the complex management offices daily to meet with the Operations Coordinator for daily instructions.
· Inventory Management:
o Following the above item the Operations Coordinator can begin work on inventory management based on the information provided by individual Unit Managers.
§ The Operations Coordinator should oversee the Unit Managers and Unit Leads in each individual building overseeing each individual project:
· Pull the Project Pull Signals for any and all projects assigned to each individual building.
· Analyze the Project Pull Signals for each project in each individual building to ensure operational efficiency.
· Review the previous shifts sequencing.
· Review any and all holds for individual projects per building and communicate with the Unit Managers about the holds.
· Review “Tablo Reports” for projects in individual buildings as needed.
· Review Bill of Ladings as needed and necessary.
· Provide Bill of Ladings to Security Staff at the Security Office at the start of every shift.
· Utilize and file any necessary paperwork from Unit Managers.
· Review Kenworth Based Computer Systems.
· Respond to necessary Kenworth communications via email or phone calls to best ensure effective and efficient costumer relations.
· Individual Buildings at the MJM Complex:
o Daily, throughout the shift, get inside every individual building at the MJM Complex.
o Be visible to employees.
o Be accessible to employees.
o Check in on operations via the building management offices.
· At the Close of Your Shift:
o Check in with every Unit Manager under your supervision and collect daily shift based and project-based Bill of Ladings.
o Review the grounds for cleanliness, organization, and safety purposes:
§ Forklifts in designated locations.
§ Trucks and trailers in designated locations.
§ Areas free of trash and debris inside and outside the building.
o Organize inventory management.
§ Review final “Tablo Reports” for the next Operations Supervisor to use as their shift begins.
§ Review sequencing via the MSS Data Entry Supplier Portal.
§ Review any Bills of Lading for the next Operations Supervisor to use as their shift begins.
o Clean up your work space, log out of any and all computer software.
Weekly Expectations: TO CLOSE EACH WEEK DO THESE THINGS:
· Collect and Review Weekly Progress Reports:
o Each Building Manager will produce and submit a Building Weekly Progress Report to the Operations Coordinator.
o These Building Weekly Progress Reports are due to the Operations Coordinator by 1:00 pm of the Unit Manager’s final shift of the work week.
o The Operations Coordinator will review the Building Weekly Progress Reports:
§ Make note of any issues to address.
§ File the Building Weekly Progress Reports in individual Building Files Electronically and in Hard Copy Form.
· Create and Submit Weekly Progress Reports:
o Each Operations Coordinator will create a Complex Weekly Progress Report and submit the Complex Weekly Progress Report to the MJM Ownership Team.
o These Complex Weekly Progress Reports are due to the MJM Ownership Team prior to the close of the Operations Coordinator’s final shift of the work week.
· Report all Bill of Ladings to Human Resources Department:
o Divide Bill of Ladings by Building and then by Individual Projects assigned to those buildings.
o Submit the Bill of Ladings to the Human Resources Department prior to the close of the Operations Coordinator’s final shift of the work week.
2. Best Efforts of Employee. The Employee agrees to perform faithfully, industriously, and to the best of the Employee's ability, experience, and talents, all of the duties that may be required by the express and implicit terms of this Contract, to the reasonable satisfaction of the Employer. Such duties shall be provided at such place(s) as the needs, business, or opportunities of the Employer may require from time to time.
3. Compensation of Employee. As compensation for the services provided by the Employer under this Contract, the Employer will pay the Employee an annual salary of negotiated amount. This amount shall be paid weekly, no later than five work days after the payroll period that ended on the preceding Friday and subject to applicable federal, state, and local withholding. Upon termination of this Contract, payments under this paragraph shall cease; provided, however, that the Employee shall be entitled to payments for periods or partial periods that occurred prior to the date of termination and for which the Employee has not yet been paid, and for any commission earned in accordance with the Employer's customary procedures, if applicable. Accrued vacation will be paid in accordance with state law and the Employer's customary procedures (see MJM Logistics, LLC Employee Handbook). This section of the Contract is included only for accounting and payroll purposes and should not be construed as establishing a minimum or definite term of employment.
4. Recommendations for Improving Operations. The Employee shall provide the Employer with all information, suggestions, and recommendations regarding the Employer's business, of which the Employee has knowledge, that will be of benefit to the Employer.
5. Confidentiality. The Employee recognizes that the Employer has and will have information regarding the following:
- Processes
- Technical matters
- Customer lists
- Prices
- Costs
- Business affairs
and other vital information items (collectively, "Information") which are valuable, special, and unique assets of the Employer. The Employee agrees that the Employee will not at any time or in any manner, either directly or indirectly, divulge, disclose, or communicate any items of Information to any third party without the prior written consent of the Employer. The Employee will protect the Information and treat it as strictly confidential. A violation by the Employee of this paragraph shall be a material violation of this Contract and will justify legal and/or equitable relief.
6. Unauthorized Disclosure of Information. If it appears that the Employee has disclosed (or has threatened to disclose) Information in violation of this Contract, the Employer shall be entitled to an injunction to restrain the Employee from disclosing, in whole or in part, such Information, or from providing any services to any party to whom such Information has, or may have been disclosed or may be disclosed. The Employer shall not be prohibited by this provision from pursuing other remedies, including a claim for losses and damages.
7. Confidentiality After Termination of Employment. The confidentiality provisions of this Contract shall remain in full force and effect for a period of two years after the voluntary or involuntary termination of the Employee's employment. During such period, neither party shall make or permit the making of any public announcement or statement of any kind that the Employee was formerly employed by or connected with the Employer.
8. Employee's Inability to Enter into Contracts on Behalf of the Employer. The Employee shall not have the right to make any contracts or commitments for or on behalf of the Employer without first obtaining the express written consent of the Employer.
9. Benefits. The Employee, as of September 1, 2024, will have the option to accept MJM Logistics, LLC employment benefits following successful completion of the Employee’s Probationary Period (See MJM Logistics, LLC Employment Handbook), as provided by the Employer's policies in effect during the term of employment. These benefits include:
- Vacation
- Health Insurance (including Dental and Vision)
- Life Insurance
- Pension Plan
10. Term/Termination. The Employee's employment under this Contract shall be for an unspecified term on an "at will" basis. This Contract may be terminated by the Employer upon two weeks written notice, and by the Employee upon two weeks written notice. If the Employee is in violation of this Contract, the Employer may terminate employment without notice and with compensation to the Employee only to the date of such termination. The compensation paid under this contract shall be the Employee's exclusive remedy.
11. Compliance with Employer's Rules. The Employee agrees to comply with all of the rules and regulations of the Employer.
12. Return of Employer Property. Upon termination of this Contract, the Employee shall deliver to the Employer all property which is the Employer's property or related to the Employee's company (including MJM Logistics, LLC clothing, keys, records, notes, data, memoranda, models, and equipment) that is in the Employee's possession or under the Employee's control. Such obligation shall be governed by any separate confidentiality or proprietary rights agreement signed by the Employee.
