Legislative Staff Attorney JOB TYPE: Full Time LOCATION: Legislative Branch REPORTS TO: Legislative Counsel SALARY RANGE: $105,000 to $130,000 Any individual who receives an offer of employment or will receive a payroll check are required to submit to a drug and alcohol test as a condition of obtaining employment. Mille Lacs Band Member/American Indian preference applies SUMMARY: The Legislative Staff Attorney assists in representing the Mille Lacs Band of Ojibwe Band Assembly in the lawful exercise of its constitutional and statutory duties and obligations. The Legislative Staff Attorney also conducts legal research, drafts bills and legal opinions, reviews contracts, and performs other duties as assigned by the Legislative Counsel. The Legislative Staff Attorney regularly interacts with the Secretary-Treasurer, District Representatives, Commissioner of Finance, Legislative Counsel, Parliamentarian, and other legislative staff members to achieve the goals and aspirations set by the Band Assembly. The position requires providing competent legal advice, timely responses, and appropriate resolutions to complex legal questions for the Legislative Branch elected and appointed officials. QUALIFICATIONS: • Graduate of an American Bar Association approved law school with a Juris Doctor degree. • Minimum of three (3) years of legal experience, preferably in legislative, governmental, or tribal law setting. • Familiarity with or willingness to learn Federal Indian and/or tribal law. • Licensed to practice law in the State of Minnesota or willing to become licensed in the State of Minnesota. Willing to become licensed in the Mille Lacs Band Court of Central Jurisdiction. Willing to present a Certificate of Good Standing upon request. • Ability to draft and amend resolutions, policies, orders, ordinances, and statutes, and ensuring compatibility of the same with existing law. • Skilled in providing prompt, practical, and legally sound advice. • Ability to work independently and exercise a team orientation. • Excellent writing and verbal communication skills • Strong research, analytical, and statutory interpretation skills. • Ability to complete assignments in a timely manner. • Windows software proficiency. • Demonstrates an awareness and sensitivity to the Mille Lacs Band culture. • Must provide a writing sample no more than eight (8) pages long. • Must provide three (3) professional references. • Must have current valid driver’s license. • Must be insurable under the Mille Lacs Band Drivers Insurance policy. • Must pass a pre-employment drug and alcohol test. • Background investigation required that shows no theft or fraud above a misdemeanor, no felony convictions, and no sexual or crimes-against-a-person conviction at any level. Any pending criminal cases must be disclosed in writing including the date of the charge, the jurisdiction where the charge took place, and the status of the case. DUTIES AND RESPONSIBILITIES: • Propose, draft, and amend resolutions, policies, orders, ordinances, and statutes. • Ensure compliance of the foregoing with the Constitution of the United States, Constitution of the Minnesota Chippewa Tribe, Indian Civil Rights Act, and applicable treaties and federal statutory and case law. • Prepare informal and formal opinions and memoranda on various legal issues as assigned by the Legislative Counsel. • Support review of Commissioner’s Orders after presentation to the Band Assembly. • Support evaluation of agreements, contracts, cooperative and reciprocity agreements, and memoranda of understanding presented by the Executive Branch. • Collaborate with the Parliamentarian to effect legislative development. • Attend Band and Joint Assembly meetings within the various districts. • Attend Minnesota Chippewa Tribal Executive Committee meetings as requested. • Perform other duties as assigned.
