Role Summary:
We're looking for a dynamic Senior Commercial Counsel to support the rapidly expanding Energy Storage Systems (ESS) division. This role is deeply integrated with Sales and Operations, offering strategic legal guidance throughout the full contract lifecycle-from deal structuring to post-commissioning support. You'll play a key role in accelerating revenue, streamlining negotiations, and ensuring robust risk management across complex commercial agreements.
Core Duties:
Commercial Strategy & Negotiation
- Draft, review, and negotiate ESS-related contracts including EPC, Supply, and Tolling agreements.
- Collaborate closely with Sales to craft commercially sound, risk-aware deal terms.
- Represent the company in customer negotiations and internal approval processes.
End-to-End Contract Oversight
- Own contracts from initial negotiation through execution, implementation, and closeout.
- Monitor key deliverables, obligations, amendments, and renewals to ensure compliance.
- Conduct post-signature risk reviews and apply insights to future deals.
Project & Operational Advisory
- Advise Project Management on contract interpretation, issue resolution, and change orders.
- Oversee warranty terms, SLAs, and post-installation obligations in coordination with Service and Operations teams.
Process Optimization & Governance
- Develop and refine templates, playbooks, and workflows to improve consistency and efficiency.
- Partner with Legal & Compliance to align escalation protocols and risk frameworks.
- Contribute to the evolution of contract governance as the business scales.
Qualifications:
- J.D. degree with active bar membership in at least one U.S. jurisdiction.
- 7 years of experience in commercial contracting, ideally within energy, infrastructure, or tech sectors.
- Strong expertise in drafting and negotiating complex agreements.
- Proven ability to balance legal risk with business objectives.
- Excellent interpersonal, negotiation, and communication skills.
- Comfortable working in a fast-paced, cross-functional, global environment.
- Prior in-house counsel experience preferred.
- Experience with EPC and system integration contracts is a strong plus.
