Position Summary & Responsibilities

Position Summary:  

If you are passionate about protecting and serving the citizens of Kansas, the Attorney position at the Kansas Department of Insurance will be ideal for you.  The position will play a vital role in ensuring compliance with the Kansas Insurance Code and other applicable laws by Pharmacy Benefits Managers (PBMs) and related entities transacting business in the State of Kansas. The successful candidate will focus on key regulatory functions related to the oversight of Pharmacy Benefit Managers including complaint resolution, regulatory reporting, licensing requirements and enforcement activities.

Job Responsibilities may include but are not limited to the following:  

  • Review and analyze legislative proposals, public policy matters and grievances submitted by consumers, pharmacies, insurers, and companies related to PBMs.
  • Provide legal support to the financial surveillance division on matters related to PBMs and assist other divisions within the agency as needed. 
  • Assist with the development and execution of examinations related to PBMs.
  • Responsible for research, drafting regulations, interpreting statutes, enforcing the penalty provisions of the insurance statutes through formal hearings, and the negotiation and the preparation of legal orders. 
  • Provide guidance to ensure compliance with PBM quarterly and annual reporting requirements.
  • Represent the Commissioner and the Department at public events.
  • Review, revise, and draft administrative regulations in collaboration with Department staff at the direction of the General Counsel or Assistant General Counsel.
  • Collaborate and participate in national groups as assigned and communicate with other state regulators on matters related to PBMs.

Qualifications

EducationGraduation from an accredited law school.

Licensing & CertificationCertificate of admission to the Bar of the Supreme Court of Kansas.

Minimum Qualifications:  

  • Knowledge of judicial procedures and the rules of evidence required.
  • Knowledge of the principles, methods, materials, and practices of legal research required.
  • Knowledge of the methods and practices of pleading and presenting civil cases required.
  • Ability to analyze, appraise, and organize facts, evidence, and precedents concerning cases and to present such materials in clear and logical form for oral or written presentation, such as briefs, opinions, orders, or decisions required.
  • Ability to analyze legal documents and instruments required.
  • Ability to establish and maintain effective working relationships with other employees, insurance company representatives and the public required.

Preferred Qualifications:  

  • Experience and knowledge in administrative and insurance law.
  • Experience and knowledge of health law including issues related to PBMs.
  • Proactive problem solving.
