BASIC FUNCTION: Serves as the primary Title IX Investigator for cases alleging student sexual assault, sexual misconduct and harassment complaints, involving students, and persons who serve the University as its agents. SUPERVISORY ACCOUNTABILITY: Coordinates University’s response, prevention and education initiatives pursuant to Title IX and related statutes and regulations. NATURE AND SCOPE: Interacts regularly with Department of Public Safety, Office of Student Affairs, and Office of the General Counsel and may serve on a variety of committees designed to address student health, safety, and welfare. PRINCIPAL ACCOUNTABILITIES: Performs Title IX investigations from inception to resolution, and drafts memoranda related to various steps throughout the process, including but not limited to memoranda of findings and recommendations. Thoroughly reviews and synthesizes all allegations of Title IX violations to determine appropriate charges and determine if allegations and preliminary findings call for interim remedial measures. Leads witness interviews, analyzes witness statements, makes credibility assessments, records findings of fact, and communicates with parties’ and witness’ advocates while protecting the independence, integrity, and confidentiality of the investigation. Provides on-going updates regarding the status of complaints received and investigations in progress to the Title IX Coordinator. Drafts and presents memoranda of findings and appropriate supporting documentation related to the resolution of each matter to the Title IX Coordinator. Recommends appropriate sanctions in accordance with the Title IX policy and Student Code of Conduct when decisions result in findings of a violation. Collaborates with the Title IX Coordinator to identify and address any systemic problems relating to complaints. Applies statistical analysis methods and tools to track and document cases of sexual assault, sexual misconduct and harassment to collect data for purposes of determining problems, issues, trends and patterns. Develops plans of education and presents subject matter training programs to students, parents and faculty/staff. Identifies and integrates best practices in the Title IX investigation arena into knowledge base and practice. Stays abreast of current movements in field of student conduct investigations and monitors changes and developments in the law regarding sexual harassment, gender-based discrimination and other items addressed by Title IX, the Cleary Act, and any other legislation or regulations by participation in listservs; building relationship with colleagues at peer institutions; reviewing current literature and research and attending regional or national professional association and organization conferences. Collaborates with a wide variety of on and off-campus partners to ensure progressive and effective education and prevention initiatives are provided. Conducts interviews and investigations of potential violations of the Student Code of Conduct as requested by the Dean of Students. Adjudicates cases and recommends sanctions as appropriate. Performs other job-related duties as assigned. CORE COMPETENCIES: Knowledge of the complexities surrounding sexual assault, sexual violence, sexual harassment and gender-based discrimination cases in a college setting, including experience conducting investigations in a sensitive and confidential manner. Demonstrated knowledge of investigation or interviewing for information gathering is required. Familiarity with roles and responsibilities of University officials and students’ rights under FERPA and HIPAA legislation. Experience and desire to work with college students and to collaborate with academic and administrative units. Familiarity with Title IX rights and responsibilities. Must demonstrate superior judgment with the ability to manage highly sensitive and confidential communications. Strong interpersonal skills with the ability to remain neutral. Ability to be self-motivated, plan, organize, and manage multiple tasks simultaneously in a highly demanding environment. Ability to work independently, efficiently and effectively as part of a team on projects and assignments. Ability to work occasional evenings and weekends as necessary. MINIMUM REQUIREMENTS: A Bachelor’s degree is required. A minimum of five (5) years of progressively responsible experience which should include experience in conducting investigations and in complaint and grievance resolution.
