Job Summary: The Staff Attorney will play a vital role in maintaining the integrity and performance of the Hoffman Risk Management department. They will report to the General Counsel and support In-House Associate General Counsel with contract-related needs and some claim handing of Hoffman Construction and its affiliates. The Staff Attorney will drive issue resolution, noting system improvement opportunities throughout while maintaining a desire to learn the “why” behind the current structure and established processes. This position will be fully onsite, at our Lake Oswego main office.

Essential Responsibilities

Contract Management

  • Review proposed client contracts, identifying deviations from the company’s standards.
  • Assist in codifying Contracting Standards.
  • Prepare detailed abstracts summarizing key notice and other provisions in client contracts.
  • Track and update client contracts to support project management contract administration.
  • Support the review, negotiation, and administration of contracts, including construction contracts, vendor contracts, subcontractor agreements, and other legal documents.
  • Ensure compliance with contractual obligations, monitor contract performance, and assist with the management of any contract disputes.


Risk Management

  • Identify relevant industry regulations, precedents, and best practices as they pertain to company legal documents, contracts, and agreements.
  • Ensure documents, contracts, and agreements are accurate, enforceable, and protect the company’s interests.
  • Perform data analysis to proactively support claims identification and management to mitigate potential legal risk.
  • Support e-discovery and other litigation-related discovery activities.


Advisory

  • Assist with training, especially with respect to subcontracting.
  • Collaborate with construction project teams in contract and subcontract administration.


Qualifications

Professional Experience and Education

  • Juris Doctor (JD) degree from an ABA-accredited law school.
  • Admission to a state bar and in good standing to obtain in-house admission/certification.
  • Ability to obtain admission to the Oregon state bar
  • At least three (3 ) years of working experience in construction law or a related field at a law firm preferred.

Physical And Mental Requirements

  • Standing/Walking/Sitting: Workday is a combination of being stationary and moving about the work location.
  • Must be able to work outdoors in varying weather conditions and on active construction sites.
  • Must be able to climb stairs, to ascend and descend ladders, scaffold, inspect confined or underground spaces.
  • Hands/Arms: Constantly operates a computer and other office productivity machinery. Frequently operates machinery and will use hand/fingers and legs to operate, activate, use, prepare, inspect, place, detect, and position materials.
  • Sight: Specific vision abilities required include close vision, depth perception and the ability to adjust focus in an outdoor environment. Must be able to safely operate a vehicle with a valid driver’s license. The work is required to have close visual acuity to perform an activity such as preparing and analyzing data and figures, transcribing, viewing a computer terminal, reading print and digital documents.
  • Hearing: Must be able to work in proximity to loud equipment more than 75% of the time. Must be able to wear hearing protection, as necessary. Often required to communicate with customers and co-workers in an office setting and on the job site.
  • Speech: Ability to communicate laws, ordinances, plans, regulations, protocols, directives, and standard operating procedures related to project scope in English.
  • Lift/Carry: Must have the ability to lift or manipulate fifty pounds to a height of three feet and carry or push it 50-100 feet.
  • Bending/Twisting: Frequent.
  • Kneeling/Crouching/Crawling: Must be able to regularly position self in a kneeling, crouching or crawling position for purpose of examining project work.
  • Must be able to physically access all areas and levels of construction site for work progress review.
  • Work schedule must be flexible to allow for extended hours or off-shift work to accommodate changing construction schedule and sequences.
  • Must use independent judgment, organizational and critical thinking skills to determine best method to accomplish desired results.
