Work Location & Flexibility
- Primary Litigation Location: South Dearborn Street, Chicago, IL 60604, or New York court.
- We have physical offices in Chicago, New York, and Houston.
- However, remote work is highly acceptable.
Position Overview
As a core legal expert for the group in the US market, you will spearhead intellectual property (IP) matters and manage complex litigation.
- Bar Admission: Must be admitted to the Illinois or New York State Bar
- Practice Area: Cross-border Litigation / Intellectual Property
- Reporting Entity: US Subsidiary
Core Responsibilities
Your primary focus will be navigating US-based litigation defense and offense, centered on IP litigation, while occasionally managing general commercial disputes.
1. Intellectual Property Litigation (Primary Duty)
Act as the lead counsel managing the entire lifecycle of IP disputes.
- Case Representation: Represent the US subsidiary in litigation involving patents, trademarks, copyrights, and trade secrets.
- End-to-End Case Management: Lead and oversee all stages of litigation, including pre-suit evaluation, evidence collection, strategy formulation, drafting pleadings/answers, managing the discovery process, oral arguments, and settlement negotiations.
- Cross-Border Collaboration: Serve as the primary liaison for the US company, collaborating with our domestic headquarters team to efficiently control litigation costs and project timelines.
2. General Commercial & Corporate Litigation
Handle non-IP disputes that may arise within the US subsidiary.
- Dispute Resolution: Manage contract disputes, debt recovery, labor and employment issues, and regulatory compliance litigation.
- Local Counsel Management: Coordinate and collaborate effectively with local trial counsel when necessary to advance court proceedings.
3. Value-Added Responsibilities (Preferred/Bonuses)
- Assist domestic R&D/legal teams with trademark and patent filings.
- Provide Freedom to Operate (FTO) analysis and legal opinions for new products or technologies.
Qualifications & Requirements
Minimum Qualifications:
- Education & Credentials: Juris Doctor (J.D.) degree from an ABA-approved law school and active admission to the Illinois Bar or New York Bar.
- Experience: Proven hands-on track record in US IP litigation. Experience in patent litigation is highly preferred.
- Language Proficiency: Professional bilingual fluency in English and Mandarin (written and spoken). Must be fully capable of independently drafting professional English pleadings, motions, and legal opinions, while effectively communicating with cross-border teams.
Preferred Qualifications (Big Plusses):
- Admitted to practice before US Federal District Courts.
- Experience handling Section 337 investigations before the US International Trade Commission (ITC) or patent post-grant proceedings before the Patent Trial and Appeal Board (PTAB).
- Registered USPTO Patent Attorney or Agent (passed the Patent Bar).
