We are seeking a skilled and experienced In-House Litigation Attorney to join our legal team in Arizona. The ideal candidate will be responsible for managing and overseeing the company’s litigation matters, providing legal advice and support to various internal departments, and ensuring that all legal risks associated with litigation are effectively mitigated. ROLES & RESPONSIBILITIES
Litigation Management:
- Oversee and manage the company’s medical malpractice litigation portfolio, including pre-litigation matters, ongoing lawsuits, and disputes.
- Coordinate with external counsel and manage outside law firms for complex litigation matters.
- Develop and execute litigation strategies and case management plans.
Legal Advice & Counsel:
- Provide legal advice to senior management and other departments on a variety of issues related to litigation.
- Identify potential legal risks and develop proactive measures to mitigate them.
- Counsel management on settlement opportunities, strategies, and risk assessments.
- Attend depositions, trial, and other in-person litigation tasks in coordination with hired outside counsel as needed.
- Review records responsive to medical records requests received from agencies, residents, family members and law firms to determine appropriate response based upon language of request.
Document Review & Preparation:
- Draft, review, and negotiate legal documents, including motions, pleadings, discovery requests, and settlement agreements.
- Oversee and manage the discovery process, including document review, production, and responding to discovery requests.
- Oversee subpoena responses received from state agencies to determine appropriateness of response
Compliance & Risk Management:
- Ensure that all litigation activities are in compliance with applicable state and federal laws and regulations.
- Support the development and implementation of company-wide compliance programs related to litigation and disputes.
Communication & Reporting:
- Regularly report on the status of litigation matters to senior leadership and key board members.
- Collaborate with other departments, including compliance, HR, and finance, to ensure consistent legal advice across the organization.
Training & Education:
- Provide internal training to employees and managers on litigation-related topics, including contract disputes, risk avoidance, and best practices.
REQUIREMENTS
- Juris Doctor (JD) degree from an accredited law school.
- Active membership in good standing with the Arizona State Bar.
Experience:
- Minimum of 5-7 years of experience in litigation, preferably in an in-house corporate environment or at a law firm specializing in business disputes.
- Experience in managing all phases of litigation, from initial case assessment through trial and appeal.
- Strong understanding of Arizona and federal court rules, civil procedure, and litigation processes.
Skills & Competencies:
- Strong analytical, problem-solving, and decision-making abilities.
- Excellent communication skills, both written and verbal, with the ability to explain complex legal matters clearly.
- Proven ability to manage multiple priorities and meet deadlines in a fast-paced environment.
- Strong negotiation skills and the ability to handle sensitive and confidential information.
- Ability to work collaboratively in a cross-functional team environment.
Desirable Skills:
- Experience in medical malpractice defense, skilled nursing/APSA litigation preferred.
- Familiarity with alternative dispute resolution (ADR) methods, including mediation and arbitration.
Job Type: Full-time position, with occasional overtime required during busy litigation periods.
