JOB TITLE: Prosecuting Attorney
DIVISION: Courthouse
SUMMARY:
The purpose of this position is to serve as chief law enforcement official for Gogebic County and all County law enforcement agencies. This position reviews criminal/civil cases on behalf of the People of the State and determines propriety of the methods to be used in prosecution. This position also directs prosecutions in District, Probate, and Circuit Court and represents the County in a variety of legal actions, hearings, and proceedings. This position directs support staff and coordinates activities with the County Board of Commissioners, and serves as legal counsel to the County Board of Commissioners and operating agencies.
JOB DUTIES
PRIMARY DUTIES:
The tasks listed below represent most of the time spent working in this position.
1. Establishes appropriate departmental policies and procedures for the orderly intake and evaluation of criminal or civil actions proposed by County departments and police agencies.
2. Evaluates the nature of alleged occurrences/crimes in view of available facts, legal precedent and methods used in apprehensions, evidence gathering, and events. Seeks additional information, clarification, supportive facts, and witnesses.
3. Advises law officers on the procedures to be followed to avoid the dismissal of prosecution/revised charge(s). Issues warrant orders after evidence evaluation if convinced a crime was committed and suspects have reason to be prosecuted.
4. Represents the County Board of Commissioners and its agencies on matters of financial business concern, e.g. contracts, pending litigation, management, and general counsel.
5. Reviews case circumstance and represents the County on matters, such as Juvenile Court actions, mental commitment hearings, guardianship proceedings, and protective actions. Initiates actions and represents petitioners in child support actions in which parents and children are eligible for public assistance. Represents parents in paternity complaints.
6. Directs case preparation and presents criminal and civil cases, representing the State in preliminary examinations, hearings, arraignments, pre-trial conferences, and prosecutions. Makes motions and may bargain, and attends sentencing and disposition hearings.
7. Evaluates results of legal actions and conducts complex research relating to appeals, propriety of same, and additional or alternative charges. Receives citizen requests for formal complaints, and advises on legal aspects and provides general information.
8. Advises law enforcement officers on legal actions, propriety of search warrants, and issuance of same on an on-call basis. Maintains continuous liaison with police agencies and advises, counsels, and directs prosecution efforts.
9. Oversees and participates in the administration of the area Uniform Interstate Family Support Act (UIFSA) between Michigan and other states compelling collection of child support. Enters into contracts with Michigan Department of Health and Human Services for work relating to child support and paternity, child protective services, and crime victims' rights.
10. Prepares preliminary department budget, defends contents, and monitors final budget during the fiscal year to ensure conformity to expenditure points.
11. Assigns supportive responsibilities to staff, monitors performance, provides training, and initiates procedural changes, trainings, and disciplinary actions as needed.
OTHER DUTIES:
Explains functions and activities of the Prosecutor to interested civic groups, news media, and individuals. Develops County procedures on matters of high public interest, such as major criminal prosecutions. Responsible for enforcing/prosecuting animal control violations. Reads extensively and attends seminars to keep current on changing law(s), procedural methods, developments, and the interpretation of case law.
QUALIFICATIONS
Must be a qualified elector within Gogebic County.
EDUCATION AND EXPERIENCE REQUIREMENTS:
Completion of a Doctorate - Jurisprudence.
CERTIFICATIONS AND LICENSES:
Must possess a valid state driver's license. Must be a licensed practicing attorney in the state of Michigan.
Knowledge of principles, practices, and procedures related to District Court programs and operations.
Knowledge of applicable federal, state, and local laws and regulations. Knowledge of and the ability to work with computer applications. Ability to establish, maintain, and demonstrate effective working relationships.
Knowledge of court operations, legal procedures, court rules, and statutes. Must have strong written and verbal communication skills and strong conflict management abilities.

Requires work involving: standing, walking, sitting, and lifting up to 25 pounds less than 1/3 of the time; gripping or feeling with hands, reaching with hands and arms, talking or hearing over 2/3 of the time.
