Job Overview

The Senior Associate General Counsel role will provide legal counsel to the operations area at Fairview Health Services under the general direction of the Chief Legal Officer and reporting to the Vice President, Senior Associate General Counsel . This role will be responsible for drafting, reviewing, and negotiating various health system contracts, including those related to community advancement, research, laboratory services, imaging, rehabilitation, rehabilitation, clinical professional services arrangements and supply chain or other contracts as delegated. The role is also responsible for providing regulatory and compliance guidance on the above areas, and others as designated, and interactions with applicable agencies such as CMS, FDA, OIG and other state healthcare regulatory agencies.

 

In addition to delivering strategic legal advice, this role will collaborate with business leaders, auditors, and investigators to ensure compliance with applicable laws and regulations. The role will provide support to internal teams by refining contracting processes, training executives and management, and staying informed on evolving legal and regulatory requirements impacting healthcare and operational areas of responsibility. This position requires strong analytical skills, sound judgment, and the ability to manage multiple complex legal matters in a fast-paced environment while working both independently and as part of a team.

 

Job Expectations:

Providing knowledge and practical legal advice regarding any number of federal, state, and local law topics related to assigned business units
Working with clients in the organization to understand issues and priorities, apply sound legal analysis, and identify actionable solutions that meet client needs while maintaining compliance with applicable laws, regulations, and Fairview policies.
Expertly managing claims, charges, and litigation in partnership with outside counsel, as needed.
Leading complex, cross-functional projects supporting Fairview’s business priorities in alignment with Fairview’s strong compliance culture. May work independently or with a more senior attorney on projects of very high impact or complexity.
Formulating strategies and/or make recommendations regarding strategic matters to senior colleagues or senior management.
Developing and leading training on a range of law topics.
Developing and sharing knowledge and best practices with colleagues in support of a collaborative and high functioning team environment.
Develop, revise and mature policies and procedures supporting assigned business units and train management and executives on an ongoing basis.
Handle multiple legal matters and coordinate with other members of the Fairview legal and compliance teams on regulatory, risk, compliance, and operational issues.
Stay apprised of important changes in law and regulation and counsel business leaders and other leaders on such changes.
This position will primarily partner with Fairview’s compliance team to advise the Revenue Cycle team on a variety of matters, including: billing and coding; collections (including 501(r), Attorney General agreement, FDCPA, and other applicable laws and regulations); internal and external audits; relationships with third party vendors; balancing payer relationships with revenue opportunities.
This position will also assist the Legal Department in other subject areas as needed, including data use, supply chain, and other areas as required.

 

Required:

  • Juris Doctorate from an accredited law school with a strong academic record
  • Admission to the Bar in state of MN allowing ability to practice in MN within six months of hire
  • 7 years recent and relevant experience in particular legal area
  • Substantive knowledge and experience with relevant health care compliance issues in assigned business units
  • Strong analytical skills and ability to develop solutions and recommendations quickly and accurately.
  • Excellent judgment and communication skills (both written and oral).
  • Ability to prioritize projects, stay on task, and manage workload in a fast-paced work environment.
  • Pragmatic and business-focused; ability to work collaboratively to effectively manage legal risks.
  • Comfortable working independently and collaboratively as part of a team.
  • Ability and willingness to assist with other projects as assigned by Chief Legal Officer and/or Associate General Counsel
  • Licensed to practice Law in MN

 

Preferred:

  • Experience in both in-house and foundational training obtained in a reputable law firm that focused on healthcare transactional and regulatory areas.
  • Experience working for a large, complex organization

The posted pay range is for a 40-hour workweek (1.0 FTE). The actual rate of pay offered within this range may depend on several factors, such as FTE, skills, knowledge, relevant education, experience, and market conditions.
