SALARY RANGE (Depending on Experience): $89,434.80- $130,958.10 annually

We base salary and position offers on experience and an internal equity analysis.

EXCELLENT BENEFITS including 8% 401K Match; LRAP (Loan Repayment Assistance Program) that pays up to $300/month depending on salary and debt; Differential for ability to speak and write certain languages of up to $250 per month after passing a test.

Disability Rights California (DRC) is a statewide, non-profit legal organization dedicated to advancing the rights of Californians with disabilities. DRC works to achieve equal access to services for people with disabilities through individual and impact litigation, state and federal policy and regulatory advocacy, and community education and training.

Healthcare/Home and Community-Based Services (HCBS) Practice Group

The Healthcare and Home and Community-Based Services Practice Group (“Health PG”) focuses on improving access to healthcare and home and community-based services through Medi-Cal (California’s Medicaid Program). We work to ensure people with disabilities have access to essential health care services and a full range of community-based long-term services and supports necessary to allow community living and avoid institutionalization, consistent with the principles of the Supreme Court’s Olmstead decision. The Health PG works to achieve this goal through a combination of direct representation, policy advocacy, and impact litigation.

Areas of particular focus for the Health PG include access to healthcare and HCBS Services through Medi-Cal including In-Home Supportive Services and Medi-Cal Waivers, enforcement of EPSDT protections for children and young adults under 21, and access to services including private duty nursing and durable medical equipment though the California Children’s Services (CCS) program. We also focus on Olmstead litigation and advocacy.

POSITION SUMMARY:

The Healthcare/HCBS Practice Group seeks a senior attorney who will lead advocacy initiatives within the group. Applicants should have demonstrated experience in direct representation in administrative hearings, policy advocacy, and litigation and should also possess in-depth knowledge of California’s Medi-Cal program.

JOB RESPONSIBILITIES

Essential functions are the job responsibilities an employee must be able to perform, with or without reasonable accommodation.

The Senior Attorney’s Core Responsibilities Will Be To:

  • Develop, lead, and participate in policy advocacy at the state and federal level, including commenting on and drafting legislation and regulations, and participating in stakeholder workgroups or committees.
  • Develop, lead, and participate in litigation—including individual representation and systemic litigation.
  • Represent individual clients in negotiations, mediations, and administrative proceedings.
  • Supervise and mentor the work of attorneys, fellows, and interns, as assigned.
  • Prepare or coordinate training materials, publications, reports, or special projects, or make presentations about legal work as necessary.
  • Provide technical assistance and substantive training to other Disability Rights California staff on complex Healthcare/HCBS issues.
  • Collaborate with other agencies and organizations to address systemic issues impacting access to Medi-Cal and HCBS.
  • Participate in other duties as assigned.

SUPERVISORY RESPONSIBILITIES

May directly supervise one or more attorneys or advocacy staff on the Health PG and shall carry out supervisory responsibilities in accordance with the agency's policies and applicable laws. Supervisors interview, hire, and train employees; plan, assign, and direct work; regularly evaluate performance and provide ongoing feedback; work with HR to take correction actions when needed; address complaints and resolve problems.

Requirements:

SENIOR ATTORNEY MINIMUM QUALIFICATIONS

Candidates must have a Juris Doctor degree plus seven years of experience practicing law[AL1] . Additional minimum qualifications include:

  • Demonstrated expertise in Medicaid and health care law.
  • Demonstrated ability to lead complex representation, build strong relationships, and work well in collaboration with others.
  • Four years of demonstrated experience in one or more of the following areas of practice related to the position: representation in administrative hearings, policy advocacy, civil litigation.
  • Excellent advocacy skills (such as research, writing, analytic, oral).
  • The ability to work independently with appropriate supervision.
  • The ability to meet deadlines and perform multiple tasks while maintaining attention to detail.

LICENSES / CERTIFICATES

  • Must be a member of the California State Bar, or eligible to practice under the Registered Legal Services Attorney Program.

Preferred Qualifications

  • Able to communicate fluently and write effectively in Spanish or an Asian language; or able to communicate using American Sign Language.
  • Experience with and/or extensive contacts in ethnic or language distinct communities.
  • Experience working with people with disabilities and/or experience working with people from multi-ethnic communities.

TRAVEL REQUIREMENTS

Ability to travel occasionally for activities such as meetings, trainings, or outreach activities.
