What are the responsibilities and job description for the Attorney Advisor position at Department of Corrections?

This position is located in the D.C Department of Corrections (DOC), Office of the General Counsel (OGC). The mission of the DOC is to ensure public safety for citizens of the District by providing an orderly, safe, secure, and humane environment for the confinement of pretrial detainees and sentenced inmates, while providing meaningful opportunities for community reintegration.

The OGC is responsible for providing legal advice, litigation support, ensuring compliance with District of Columbia and federal laws. The Attorney Advisor will work under the direct supervision of the General Counsel, who provides broadly defined missions.


Duties and Responsibilities

Serves as a senior attorney in the assigned agency, division, and/or area handling the more complex and difficult matters, not to include labor or personnel matters. Reviewing various legal documents and relevant case laws to determine whether execution or non-execution of proposed actions is in the best interest of the District of Columbia government. Provides statement of reasons and draft language necessary to obviate objections. Examines, researches, and analyses proposed orders, legislation, rules, regulations, policies, procedures, and other legal or legal related documents from various sources for legal sufficiency, both as to the form and substance. Work-product is both oral and written. Reviews and analyzes hearing records, including briefs, exceptions, rulings, decisions, orders, reports, transcripts, etc., not to include labor and personnel matters. Provides updates, summaries, recommendations, guidance, opinions, and strategies as appropriate.

Prepares legal memoranda, proposals and other work-product for consideration by the General Counsel, agency leadership, and/or administrative agencies. Consults frequently with providing legal advice, recommendations, and analysis as appropriate. Keeps abreast of judicial, legislative, rulemaking, and other changes in laws and regulations related to the functions of the Office/Division/Section. Recommends appropriate course of action to General Counsel and or agency leadership, as appropriate and necessary. Provides technical guidance and assistance to junior attorneys of the Office/Division/Section in areas of special expertise. Compiles monthly statistical and status reports of assigned matters.

Qualifications and Education

Must possess a LLB or Juris Doctor (J.D.) degree from a law school accredited by the American Bar Association (ABA) at the time of appointment.

Must have at least three (3) years of post-J.D. professional legal experience.

Licenses and Certifications

Must be an active member in good standing of the District of Columbia Bar or have the ability to waive in and be admitted within 360 days of appointment. An appointee to the Legal Service position shall remain a member in good standing of the District of Columbia Bar during his/her employment in the Legal Service.

Working Conditions/Environment

The work is primarily performed in an office setting and frequently performed in a jail setting. Some walking, handling and carrying light to moderately heavy objects such as case files, briefcases, and exhibits is required.

Tour of Duty: Monday - Friday 8:45 am – 5:15 pm

Pay Plan Series and Grade: LA-0905-14

Promotion Potential: None.

Operating Status: In-person reporting, flexible and limited telework options may be available upon position eligibility and operational needs. The position may require public meetings that may occur after regular office hours, as well as occasional community meetings on nights and weekends.

Collective Bargaining Agreement: This position is not in a collective bargaining unit.

Position Designation: This position has been designated as security-sensitive under the guidelines of the DC Personnel Manual. Incumbents of this position are subject to enhanced suitability screening pursuant to Chapter 4 of the DC personnel regulations. In addition to the general suitability screening, individuals applying for or occupying positions deemed security sensitive are subject to the following checks and tests: (a) Criminal background check; (b) Traffic record check (as applicable); (c) Consumer credit check (as applicable); (d) Reasonable suspicion drug and alcohol test; and (e) post-accident or incident involving Government property drug and alcohol testing.
