POSITION TO BEGIN 01/02/2024

Exempt Full-Time

DEPARTMENT: Office of the District Attorney

Venango County Courthouse

PAY GRADE: LEGAL EXEMPT GRADE TWO

$50,520.00 - $65,520.00/yr

OVERALL OBJECTIVE:

To act on authority delegated by the District Attorney to represent the Commonwealth and the County in the prosecutions of those persons who are alleged to have violated the laws of the Commonwealth and the County.

SUPERVISION EXERCISED

None.

SUPERVISION RECEIVED

Receive occasional instruction and limited supervision from the District Attorney in regard to daily work assignments.

EXAMPLES OF DUTIES/RESPONSIBILITIES

Upon authority delegated by the District Attorney:

1. Assist police in the investigation of criminal offenses.

2. Provide legal opinion to police relative to investigations.

3. Conduct legal research and write opinions thereon.

4. Advise police on the drafting of criminal complaints, search warrants and statements of probable cause.

5. Evaluate evidence relative to propriety of filing criminal charges and search warrants.

6. Assemble and evaluate evidence and investigate further if necessary assigned case.

7. Prepare formal charging documents on all assigned cases.

8. Interview and prepare witnesses for various court appearances.

9. Prepare pretrial motions and research and brief the legal issues

10. Represent the Commonwealth in preliminary hearings, trials, sentences, post sentence hearings, and other court appearances.

11. Thoroughly prepare all cases for trial, including crime scene visits, research the need for and obtain expert witnesses, travel as necessary to seek out and speak to witnesses, and legal research.

12. Prepare written briefs and make oral argument before all Commonwealth, Courts of Appeal, and Federal courts of Pennsylvania.

13. Prepare legal briefs and present witnesses at PCRA Hearings.

14. Prepare briefs for Federal Habeas Corpus Hearings in Federal District Court and all Federal Courts of Appeal.

15. Prepare and present cases in Juvenile Court as assigned.

16. Prepare and present the Commonwealth’s case at Summary Appeal Hearings.

17. Prepare PFA Violation Petitions and present the case in court.

18. Prepare for Pretrial Conferences; plea agreements; discovery issues, etc.

19. Write letters and other legal correspondence.

20. On call 24/7 to assist law enforcement with legal questions, witness interviews, and to respond to crime scenes as needed.

21. Respond to private criminal complaints from the general public.

22. Interact with all local, state, and federal law enforcement agencies.

23. Interact with internal departments, external agencies and the general public.

24. Shall equally share the criminal case load with the 1st Assistant District Attorney.

OTHER DUTIES OF JOB

1. Attend continuing education courses on criminal law and related issues.

2. Attend meetings, seminars, and training sessions as required.

3. Perform other job related work as assigned by the District Attorney.

REQUIRED KNOWLEDGE, SKILLS AND ABILITIES

1. Must be able to speak, understand, and write the English language in order to carry out essential job duties.

2. Must possess effective communication and interpersonal skills.

3. Must possess ability to function independently, have flexibility and the ability to work effectively with law enforcement, co-workers and others.

4. Must possess ability to maintain confidentiality in regard to client information and records.

5. Must possess thorough knowledge of state substantive and procedural law and rules of evidence.

6. Must possess skill and ability to analyze, organize and present facts, evidence and legal theory in legal proceedings.

7. Must possess the ability to prosecute cases effectively and prepare necessary briefs and arguments.

8. Must possess the ability to practice effective time management, organization skills and to concentrate on work and details of several cases at once.

9. Must possess the ability to understand and interpret constitutional provisions, statutes, and administrative regulations; to analyze facts, evidence and precedents and arrive at logical interpretations.

10. Must possess the ability to make independent decisions when circumstances warrant such action.

11. Must possess initiative, creativity and problem solving skills.

12. Must possess the technical knowledge of operating personal computers.

13. Must possess ability to effectively coordinate individual cases and also interact with other staff members.

14. Must possess a valid Pennsylvania Driver’s License and a willingness to travel as needed to complete job duties.

REQUIRED QUALIFICATIONS

EDUCATION/TRAINING

Juris doctor degree and admission to practice before the Supreme Court of Pennsylvania. Training in computers helpful. Continuing legal education required.

WORK EXPERIENCE

Applicants with 2 years experience working as an attorney with some experience in criminal law preferred.

CLEARANCES

Must work in conjunction with employer to apply for Act 34 PA State Police Criminal History, Act 151 PA Child Abuse and FBI clearances prior to employment. All clearances must reflect acceptable results. Clearances must be renewed at least every five years.

OTHER REQUIREMENTS

· Must not appear on Preclusion Lists as defined by “Pennsylvania’s Medical Assistance Bulletin 99-11-05 Provider Screening of Employees and Contractors for Exclusion from Participating in Federal Healthcare Programs.”

· Must successfully complete pre-employment drug screening.
