Sensitive Position and BIA Background Check required. Must complete the BIA Background Check and employment is contingent upon the successful completion of the Bureau of Indian Affairs (BIA) Background Check is approved.

Position funded by BIA 638 Contract

SUPERVISED BY: Land Project Manager direct supervisor. Lead and trainer will be the Probate Legal Administrative Specialist.

CTUIR MISSION STATEMENT

Exercise the Tribe's sovereign authority to achieve the maximum protection of resources identified in the Treaty of 1855, to protect newly acquired lands in which the Tribe has a vested interest, and to protect the lands of all citizens and residents of the Umatilla Indian Reservation. This position will protect human life, water, land, air, and wildlife by exercising professional skills and abilities to safeguard the resources of the Confederated Tribes of the Umatilla Indian Reservation.

GENERAL STATEMENT OF DUTIES

The Department of Economic and Community Development promotes the interests of members of the Umatilla Indian Reservation by creating jobs, increasing revenues, and contributing to a diversified and developed economic base by creating opportunities for the continued advancement of all sectors of the community.

CTUIR has consolidated the Probate Program under a 638 Agreement with BIA. The Probate Program compiles inventories of Indian Trust assets and family information and coordinates the timely distribution of trust assets with the Office of Hearing and Appeals (OHA), the Branch of Land Titles and Records, and the Bureau of Trust Funds Administration (BFTA).

The Probate Program collects information on the decedent's family and property and prepares it for adjudication by the Office of Hearing and Appeals (OHA). After OHA issues a probate order, the Probate Program coordinates with other trust offices (Land Title and Records and the Bureau of Trust Fund Administration) to distribute the assets to the designated heirs or beneficiaries.

EXAMPLES OF ESSENTIAL JOBS DUTIES & RESPONSIBILITIES

  • Must work as a member of the CTUIR probate team to support the work needed to be completed for probates.
  • Must work closely with the deceased's family and the NWRO Probate staff to ensure probate packages are completed efficiently, accurately, and in a timely manner. Must have the ability and interest in greeting the public and handling difficult situations in person or by phone in a professional and courteous manner.
  • Must always maintain strict confidentiality.
  • Must maintain BIA background clearance and complete necessary BIA training as needed.
  • Demonstrate experience in general office practices and procedures. Must be highly organized and have good office skills.
  • Ability to carry out assigned duties/projects in an efficient and timely manner with minimal supervision and must be able to handle multiple projects and work within defined timelines.
  • Responsible for learning the BIA probate process to complete the probate package, which is transferred to the Office of Hearing Appeals for adjudication and for a final probate decision to be issued. The package includes an original or certified death certificate and will; tribal enrollment documentation; the names and addresses of the decedent's potential heirs and devisees; original or certified copies of any marriage license, divorce decrees, or adoption papers of the decedent; and judgments or claims against the decedent's estate.
  • Responsible for understanding and how to apply the Umatilla Inheritance Code, American Indian Probate
  • Responsible for understanding and completing, when needed, appraisal requests for allotments owned by the decedent.
  • Responsible for understanding how to obtain land inventory of decedent, including the Title Status Reports.
  • Responsible for learning the Probate computerized system.
  • Must become knowledgeable about the CTUIR and internal processes.
  • Other duties as assigned by DECD Land Program Manager related to position.

ACCESS TO SENSITIVE AREAS:

May have access to sensitive personal and private information from land records. Including may have access to confidential financial information of the land program and probate cases. Must have successfully completed a BIA background check and must maintain it.

REQUIRED MINIMUM QUALIFICATIONS: (It is the responsibility of the applicant to demonstrate in writing he/she does meet the following minimum qualifications.)

1. Bachelor's Degree and (3) years' work experience within a Tribal Government Organization. OR

2. Associate's degree in general studies or a preferred Business area with five (5) years of work experience in a Tribal Government Organization OR

3. High School Diploma or Equivalent, in addition to five (5) to ten (10) years of work experience within a Tribal Government Organization.

4. Must have successfully completed the Bureau of Indian Affairs background check. Will be responsible for BIA classes and for maintaining the BIA background check.

5. Must have strong interpersonal and communication skills, including the ability to communicate effectively, orally and in writing, through concise reports, memoranda, directives, emails and letters. Must possess and demonstrate good writing, spelling, proofing, grammar and punctuation skills.

6. Must have the ability and interest to greet the public and handle difficult situations on the phone in a professional and courteous manner.

7. Must have knowledge of computer processing equipment and software, including Word, Excel, PowerPoint, Outlook, and other Office Suite software. Knowledge of computers and other office technology must be kept current by attending training as directed by the supervisor. Preferred familiar and working knowledge of GIS Software.

8. Knowledge of general office practices and procedures. The Individual must be highly organized and have good filing skills.

9. Ability to maintain a records management system.

10. Must have a valid state driver's license, reliable transportation, and meet Tribal insurance requirements.

11. Knowledge of land records and understanding of maps.

12. Basic knowledge of math (addition, subtraction, percentages).

13. Ability to carry out assigned duties/projects in an efficient and timely manner with minimal supervision and must be able to handle multiple projects and work within defined timelines.

14. Responsible and capable of sometimes handling difficult situations and can maintain confidentiality at all times of department documents, correspondence, and discussions.

15. Must be able to operate and maintain office machines (copiers, printers, scanners, etc.).

16. A skills test will be administered either prior to or following the interview.

17. Satisfactory work history based on employment references.

PREFERRED QUALIFICATIONS:

Must clearly demonstrate experience directly related to the job requirements for this position. Prior experience with Tribal Land, Probates, PROTRAC, or TAAMS training and use is desirable.

PHYSICAL DEMANDS:

  • Ability to use standard computer programs such as Microsoft Office (Word, Excel, PowerPoint, Outlook).
  • Ability to read a map from a legal description
  • Ability to stand and walk around for long periods of time.
  • Ability to sit in automobiles and/or airplanes for travel to conferences, seminars, and training.
  • Ability to lift 25-40 pounds of boxes of records or storage containers overhead to filing cabinets.

Pursuant to Tribal Workers' Benefit Code, Section 4.02.A. " All workers shall disclose any pre-existing physical or mental disorder and/or disability that could potentially affect or impair the worker's ability to perform in a reasonable and safe manner the activities involved in the position in which they work. Disclosure shall be made in the employment application or interview before commencing employment or before commencing new job duties after job reclassification, reassignment, promotion, demotion, or other change in job duties. The content of such disclosure shall be made promptly by the covered worker after submitting a claim for benefits under this Code."

SELECTION PROCESS:

Tribal Personnel Policies Manual, Section 3.01: Employment Preferences

The Tribe's employment preferences shall be as follows:

1. Indian Preference. It shall be the policy of the Tribe to provide preference in hiring opportunities within the Tribal government to CTUIR members and other Indians enrolled in federally recognized tribes. This CTUIR member and Indian preference shall apply to all decisions regarding employee hiring, promotion, and transfer.

2. Veterans' Preference. It shall be the policy of the Tribe to provide preference in hiring opportunities to veterans honorably discharged from the United States Armed Forces.

3. The employment preferences set forth in this section shall apply to all Tribal programs regardless of the program's funding source and shall apply to all classes of positions referenced in §3.05.

4. Except for the employment preferences authorized under this section, it shall be the policy of the Tribe that no employee or job applicant shall be discriminated against in pursuit of employment or career growth due to race, color, religion, gender, sexual orientation, age, or national origin.

All CTUIR Tribal positions are competitive.
