Tribal Employment Rights Ordinance Director (TERO)
Department of Tribal Administration
Hourly Wage : $29.70- $33.43 / Regular / Full -Time / Supervisory
Location : Toppenish
Responsible for implementing and enforcing the Tribal Employment Rights Ordinance pursuant to Revised Yakama Code (RYC) Title LXXI (71) TERO. Supervises the TERO staff and provides technical support and assistance to the TERO Commission whose purpose is to ensure equal and effective application of the Ordinance. Work closely with contractors, other tribal departments, and non-tribal organizations to meet the mandates of TERO. The TERO Director develops strategies to create employment and training opportunities and to eliminate discrimination of Native Tribal Members in employment hiring and practices in the workplace and to enforce Indian Preference. The TERO Director ensures that all TERO office activities are consistent with Federal and Tribal laws, policies, and procedures.
Examples of Work Performed :
Ensure the Equal Employment Opportunities Commission Contract requirements are adhered to.
Educate and ensure compliance of the TERO Ordinance by tribal and non-tribal entities.
Conducts the negotiation of TERO compliance plans.
Certify and enforce enrolled Yakama tribal member and other Native American Indian Preference for contractors and / or applicants.
Guides employees and contractors with compliance of the TERO Ordinance, including but not limited to, presentations and training.
Performs compliance reviews on job sites to verify that all prime contractors, subcontractors, and suppliers are duly allowed by the TERO Office and are adhering to their agreed upon Compliance Plan.
Helps in conducting and investigating labor-related issues and demonstrates the ability to deal with conflict resolution on formal complaints filed with TERO in a professional manner.
Shall be the neutral investigating agent responsible for investigating, researching, reporting, and documenting any information required within specified time limits. Gathers, tabulates, and analyzes factual data for investigators.
Receives requests and complaints from covered parties under TERO Ordinance and ensures proper process is adhered for follow-up.
Establish effective communication with tribal, federal, state, and other public and private entities to ensure that all bid announcements issued include a statement that the successful bidder will have to follow the TERO ordinance.
Monitor Davis-Bacon Wage Determinations of federal contracts with the Department of Labor Employment Standards Administration Wage and Hour Division, Division of Wage Determinations.
Pursue development of a federally recognized (DOL) wage rate schedule to be used on the reservation rather than enforce Davis-Bacon Rates.
Designs, develops, coordinates, and maintains TERO Databases, including the TERO job skills bank.
Facilitate soft skills for all eligible individuals to create positive working relationships with clients to create reasonable and achievable individual Self-Sufficiency Plans.
Develop and implement a model union agreement to be used with all unions who have collective bargaining agreements with any employer.
Provide monthly program activity reports to the Assistant Tribal Administrative Director.
Annually review the program's mission statement and develop goals and objectives for the program, prepare a budget and monitor goals and objectives to measure progress and effectiveness in fulfilling the needs of the program for the benefit of the Yakama Nation.
Supervise and coordinate staff training programs and make decisions relating to assignment of duties to be performed daily.
Apprise the Supervisor, Commission and Council simultaneously of all employment activities which impact TERO or the Yakama Nation.
Coordinate with YN police to keep them updated on enforcement of cease and desist or related orders
that may be enforced ensuring that the legal documents are in place and that the proper procedures have been followed.
Evaluate the TERO Ordinance on a regular basis making recommendations based on a systematic process for updating.
Ability to participate in the Pacific Northwest Regional Industry Advisory Council, Pacific Northwest TERO Region, Council for Tribal Employment Rights and Local IAC and youth programs, in accordance with Personnel Policies Manual.
While performing the duties of this job the employee must sit, use hands and fingers, stand, walk, and ascend and descent steps. The employee must regularly lift and / or move up to 20 pounds and occasionally lift and / move 30 pounds.
Knowledge, Skills and Abilities :
Knowledge and general understanding of construction and pertinent laws or rules or regulations.
Knowledge of TERO Indian Preference requirements, EEOC (Equal Employment Opportunity Commission), and Labor Laws.
Ability to investigate thoroughly to decide facts clearly and to make logical and unbiased conclusions based upon the results of investigation.
Ability to work with people from diverse cultures, ethnic and socio-economic backgrounds and possess a basic knowledge of Native American communities and always maintain cultural sensitivity.
Ability to write clear accurate reports and to express ideas effectively orally and in writing. Ability to keep strict confidentiality of sensitive information.
Ability to prove effective public relations skills and to present a professional image for TERO and the Yakama Nation.
Ability to attend commission hearings and to travel and take part in training & meetings, as recommended.
Must have working experience with Microsoft Operating System and Office Professional Applications, specifically, Word, Excel, PowerPoint, and Outlook.
Possess strong organizational skills and the ability to set realistic goals, start and follow through on complex tasks, manage time, meet multiple deadlines, and work effectively under moderately stressful conditions.
Minimum Requirements :
Bachelor's degree in business administration, Human Resources, Construction Management, or related field.
A minimum of four years of successful management or supervisory experience in the field.
Ability to obtain TERO Certification by the Council for Tribal Employment Rights Ordinance.
Ability to obtain Certification for Occupational Safety Specialist.
Must pass a pre-employment background check.
Must possess a valid Washington State Driver's License with the ability to obtain a Yakama Nation Driving permit.
Required to pass a pre-employment drug test.
Preferred Requirements :
Enrolled Yakama Preference, but all qualified applicants are encouraged to apply.
