City Attorney Investigator II positions conduct a wide variety of pre-trial investigations related to lawsuits in which the City is a party or in the prosecution of civil, criminal, or administrative cases; locate and interview witnesses; gather documents, statements and other factual material; research City Council actions or actions of other legislative bodies, review permits and plans for development and construction of private and public infrastructure and other projects; photograph and/or record evidence; participate in the discovery process; serve subpoenas and summonses; prepare declarations, affidavits and other materials required for court motions, or search and arrest warrants; analyze data and prepare reports and recommendations; attend trials and hearings to assist attorneys and testify when necessary; conduct special investigations; attend property inspections; and perform other duties as assigned.

      NOTES:
  • Eligible benefited employees originally hired on or after July 10, 2021, will be automatically enrolled in the San Diego City Employees Retirement System (SDCERS). 
  • The list established for these positions may be used to fill vacancies in the Civil Litigation, City Advisory, Community Justice, and Criminal Divisions of the City Attorney's Office.
  • City Attorney Investigator II positions may be required to work rotating and/or stand-by shifts for which they may receive additional pay.

You must meet the following requirements on the date you apply, unless otherwise indicated.
 
EDUCATION: Bachelor's Degree or equivalent education (i.e., minimum completed units = 120 semester/180 quarter).

      NOTE:
  • Additional qualifying experience may be substituted for education lacked on a year-for-year basis. One year of full-time experience = 30 semester/45 quarter college-level units.

EXPERIENCE: Two years of full-time civil, criminal, or law enforcement investigative experience performing the full range of duties involved in the investigation of civil or criminal cases, such as public liability claims, land use, constitutional claims, traffic accidents, consumer fraud, domestic violence, code enforcement, narcotics, or gang activity. Qualifying investigation experience must include the full range of investigative responsibilities, such as locating and interviewing witnesses; conducting surveillance; photographing and/or recording evidence; serving subpoenas and summonses; preparing declarations, affidavits, and other related documents for court motions, or search and arrest warrants; retaining expert witnesses and providing case-specific information to experts; and assisting attorneys at trials and hearings.

      NOTES: The following types of experience are NOT considered qualifying: 
  • Private Investigator experience limited to surveillance only.
  • Law Clerk, Legal Assistant and Paralegal experience, unless it included performing investigations.
  • Police Patrol, Insurance Appraiser and Process Server experience.
  • Experience limited to legal research and trial case preparation only.
  • Attorney experience.

LICENSE: A valid California Class C Driver's License is required at the time of hire.

HIGHLY DESIRABLE(S):
  • Experience and/or education in land use, planning, environmental regulation, and/or code enforcement.
  • Experience with real estate, title claims, permit processing, and environmental review for development projects and land use permits.
  • Experience in obtaining inspection warrants and investigating state and municipal code violations such as zoning, building, plumbing, mechanical, electrical, substandard housing, fire code, or environmental violations.
  • Experience in investigating or abating public nuisance activity, such as properties with serious health and safety violations, or experience with drug abatement or red light abatement cases.
  • Experience in investigating public tort liability claims and litigation (e.g., personal injury, dangerous condition of public property, wrongful death).
  • Experience in conducting personnel investigations (e.g., wrongful termination, discrimination, DFEH, Civil Service).
  • Experience in investigating law enforcement liability claims and litigation (e.g., 4th Amendment violations, 42 USC Section 1983, internal affairs investigations, citizen complaint investigations).
  • Experience in writing comprehensive, detailed investigation reports.
  • Experience in investigating claims related to eminent domain, real property, and California Environmental Quality Act (CEQA).
  • Experience in investigating privacy and piracy issues.

PRE-EMPLOYMENT REQUIREMENTS: Employment offers are conditional pending the results of all screening processes applicable to this position, which may include the following: confirmation of citizenship or legal right to work in the United States; completion of a pre-employment medical review and exam (which may include drug and alcohol testing); reference checks; and fingerprinting. Fingerprints will be submitted to the Federal Bureau of Investigation and the California Department of Justice for a conviction record report. Certain positions may require additional screening processes, including a polygraph examination and/or background investigation. All screening processes must be successfully completed before employment begins. A positive test result for alcohol, cannabis/marijuana, illegal drugs, or inadequately explained prescription drugs, or misrepresentation, falsification, or omission of pertinent facts in any step of the screening or selection process, may constitute cause for disqualification or termination of employment.
