GENERAL PURPOSE
Performs a variety of routine and complex clerical, administrative duties for the daily operations of compliance and collection work in administering, enforcing, and collecting fines, costs, and fees on court orders and judgments. Supervises and manages warrant processes.
SUPERVISION EXERCISED
Supervises personnel in the compliance section.
CORE COMPETENCIES:
- Interprets and applies the laws, codes, policies and procedures related to the implementation of court procedure and generation of legal documents.
- Assist in establishing collection goals for cases with delinquent accounts in which sentences were imposed before and after implementation of the collections program.
- Manage the daily operations including job assignments and the development and implementation of policies and procedures for the compliance/collections l area as adopted by the court.
- Responsible for tracking work actions and functions and compiling status and progress reports, to include documenting all collection actions taken.
- Responsible for reviewing, analyzing and evaluating information provided by a defendant requesting additional time to pay his/her fines and court costs.
- Determine defendant’s financial situation from an analysis of the financial information provided on his/her application for extension of time to pay and from a one-on-one interview with the defendant.
- Interview applicant and establish terms for payment or other disposition of fines and court costs and review the decision in detail with the defendant to ensure the payment arrangement is understood.
- Supervises the warrant and capias pro fine process to ensure the integrity of the process.
- Schedules staff, monitors and approves leave and ensures subordinates have the necessary tools to perform the job.
- Oversees compliance of the courts mandatory collection program, as mandated by the Code of Criminal Procedure and standing judicial orders.
- Oversees the compliance of court ordered payment plans, mandatory notices and telephone contact to delinquents defendants, and the processing of capias pro fines.
- Conducts research and skip-tracing using various databases and tools to locate, investigate, and contact persons owing monies to the court.
- Effectively utilizes the services of private collection companies and the Department of Public Safety’s Failure to Appear program.
- Researches and resolves collection account discrepancies and troubleshoots related problems.
- Enters, maintains, and updates case information.
- Compiles and maintains statistics and data on collection performance and provides related reports to court management, and others as required.
- Participates in the development of collection related forms, policies and procedures.
- Attends meetings and training as required. May be tasked with serving on a variety of committees.
- Adheres to assigned work schedule as outlined in the Department and City attendance policies and procedures; ensures all behaviors comply with the City’s Personnel Rules and Regulations.
- Performs other duties as assigned.
Education and Experience:
- Associate degree in management, sales or related field; and
- Two (2) years of collection or sales; and
- Two (2) years of management experience; or
- Any equivalent combination of education and experience.
Knowledge, Skills and Abilities:
- Municipal court experience preferred.
- Working knowledge of computers and some knowledge of accounting principles and practices.
- Considerable working knowledge of modern office practices and procedures.
- Ability to perform arithmetic computations accurately and quickly.
- Ability to set goals/objectives and work without direct supervision.
- Ability to communicate effectively, orally and in writing.
- Ability to communicate effectively with the public.
- Ability to accurately proofread and verify data.
- Ability to manage workload to maximize productivity and efficiency.
- Ability to establish and maintain an effective working relationship with employees, other departments, outside agencies, officials and the public.
- Ability to exercise sound judgment.
- Ability to compile, prepare and design reports.
- Ability to accurately process legal documents.
- Ability to maintain regular and punctual attendance.
- Ability to work with difficult defendants and to de-escalate volatile situations in the collections process.
SPECIAL REQUIREMENTS
- Must have a valid driver's license by date of hire.
- Must obtain and maintain a Texas Driver’s License within 90 days of hire.
- Must be designated as a Deputy Court Clerk for the purpose of administering oaths and processing court documents.
TOOLS AND EQUIPMENT USED
Mainframe computer system, personal computer and specialized software, including but not limited to MS- Office Suite - Word, Excel, telephone, copy and fax machines.
