Brief Description

Job Summary

Under broad administrative direction from the City Attorney, exercises significant independence and considerable discretion. Provides general legal counsel to the City of Greenville Police Department (“GPD”), City of Greenville Fire Department (“GFD”), and Buildings, Codes, & Property Maintenance Department (each a “Public Safety Department,” and collectively, “Public Safety Departments”) and Public Safety Department employees in their professional capacity in matters of policy, law, and regulations. Conducts comprehensive, accurate, and timely legal research in all areas of the law impacting Public Safety Department operations including, but not limited to, the following: criminal, constitutional, employment, contracts, The South Carolina Freedom of Information Act (“SCFOIA”), and general municipal law. Participates in the analysis, interpretation, development, and/or implementation of General Orders, internal policies, and/or best practices of the Public Safety Departments. In consultation and coordination with the City Attorney and Deputy City Attorney, provides legal advice and performs activities relating to SCFOIA requests directed to Public Safety Departments. In consultation and coordination with the City Attorney and Deputy City Attorney, liaises between Public Safety Departments and outside counsel regarding civil claims relating to Public Safety Departments operations. Appears before courts on behalf of Public Safety Departments as required. Supports the relationship between the Public Safety Departments and the public by demonstrating courteous and cooperative behavior when interacting with citizens, visitors, and City staff; promotes the City’s goals and priorities. Maintains absolute confidentiality of work-related issues and City information. As assigned, drafts Public Safety Department contracts. Supervises Paralegal assigned to support this position and the City Prosecutor.

  • Provide General Legal Counsel to Public Safety Departments: Conduct comprehensive, accurate, and timely legal research in all areas of the law impacting the Public Safety Departments operations including, but not limited to, the following: criminal, constitutional, employment, contracts, SCFOIA, and general municipal law. With respect to the foregoing, assess risks; provide counsel and legal opinions, reducing them to writing as necessary; present recommendations and solutions to minimize risk and safeguard Public Safety Department operations and Public Safety Department employees in their professional capacity. Provide legal advice to Public Safety Department staff on major departmental issues and projects to assist the decision makers with the legal implications of their decisions and to assist the Department in meeting its goals. Assist Public Safety Departments in developing and/or amending policies and procedures to maintain legal compliance and to reduce risk and exposure. Prepare or review agenda items as requested. Advise GPD Office of Professional Standards when requested. Assist in preparing responses to contentious public inquiries, mitigating/preventing adverse publicity for Public Safety Departments. Prepare briefs, presentations, memoranda, and correspondence on various legal issues for Public Safety Departments as requested by GPD or GFD command staff, Buildings, Codes and Property Maintenance Department and/or the City Attorney. Draft proposed ordinances, letters, and other correspondence as requested. Prepare written and oral opinions on various legal issues for Public Safety Departments as needed or requested. Monitor and advise on changes in state and federal regulations, standards and legislation governing municipal policing. Respond to external citizen complaints/requests for information as appropriate. Maintain availability and open relations with media and the public as appropriate to the position. Work with neighboring communities and other government units as appropriate. Appear before courts and at administrative proceedings to represent Public Safety Departments interests as required. In consultation and coordination with the City Attorney and Deputy City Attorney, provide legal advice and perform activities relating to SCFOIA requests directed to Public Safety Departments. In consultation and coordination with the City Attorney and Deputy City Attorney, liaise between Public Safety Departments and outside counsel regarding civil claims relating to Public Safety Departments operations. Coordinate with City Prosecutor as required.

  • Draft and Review Public Safety Department Contracts: As assigned, draft and review Public Safety Departments contracts for a wide range of goods and services. Craft contracts tailored to specialized situations with or without the use of templates. Manage the workflow to ensure that contracts are drafted and returned to appropriate Public Safety Department staff in a timely manner.

  • Supervise Assigned Staff: Supervise Paralegal assigned to support Public Safety Legal Advisor and City Prosecutor, including setting performance expectations and standards; prioritizing and assigning work; allocating staff; writing and conducting performance evaluations; ensuring staff is trained; coaching, mentoring, and counseling employees; ensuring staff compliance with departmental and City policies and procedures; and maintaining safe work environment. Approve timesheets. Review and update job descriptions in conjunction with the City Attorney and Human Resources; participate in the hiring and selection of staff for open positions; and ensure the timely documentation and disciplining of employees consistent with Human Resources policies.

Qualifications

Job Requirements

  • Juris Doctorate degree.

  • A minimum of six (6) years of experience as an attorney.

  • At least two (2) years of other legal-related (e.g., law clerk, paralegal, etc.) job experience will be considered.

  • Membership in the South Carolina Bar with Rule 403 and continuing legal education requirements met and maintained.



Preferred Qualifications

  • Experience in a related position.



Driver's License Requirements

  • Valid South Carolina Class D Driver’s License.

Knowledge of:

  • Modern and highly complex principles and practices of municipal law.

  • Legal principles and practices, including civil, criminal, constitutional and administrative law, and procedure.

  • Organization, duties, powers, limitations, and authority of City government and the City Attorney's office.

  • Judicial procedure, criminal procedure, rules of evidence and court rules.

  • Ordinances, statutes, and court decisions relating to municipal corporations.

  • Current literature, trends, and developments in the field of municipal law.

  • Methods of legal research and public agency administration.

Ability to:

  • Perform highly complex legal research and prepare written and oral opinions on various legal issues for the Public Safety Departments and apply the research to practical day-to-day operations and/or policing.

  • Serve as legal advisor to GPD Chief, GPD command staff, GFD Chief, GFD command staff, the Buildings, Codes, and Property Maintenance Director and Public Safety Department employees in their professional capacity.

  • Be available outside of customary business hours as needed.

  • Provide sound legal guidance in accordance with laws, regulations, and policies.

  • Present logically organized and clear statements of law and fact.

  • Prepare, review, and draft ordinances, resolutions, and motions.

  • Represent the interest of Public Safety Departments in drafting legislation or contracts.

  • Represent employees of the Public Safety Departments in court as needed and effectively apply legal knowledge and principles in court as needed.

  • Apply the highest level of creative thinking, complex analysis, and reasoning to originate and develop innovative program or production concepts, techniques or procedures which can have a major impact on the nature and quality of programming or operations.

  • Communicate at a superior level verbally and in writing, including capacity to communicate complex ideas compellingly to a variety of audiences.

  • Effectively manage interactions that are generally contentious and involve confidential discussions or situations where conflicting interests are apparent.

  • Effectively handle communications that involve a high degree of difficulty (i.e., contentious confidential sensitive or political) with very diverse, very important contacts both inside and outside of the organization.

  • Use discretion, persuasion, conciliation, dispute resolution, mediation, or negotiation skills when dealing with complex situations.

  • Consult on issues, presenting complex information, explaining analysis and rationale, and making recommendations with the requirement to exercise persuasion to obtain cooperation, consensus, or approval of action to be taken.

  • Maintain effective working relations with City Council, City Manager, Department Directors, City staff, court officials, external attorneys, and the public.

  • Provide training, guidance, and direction to Public Safety Departments and subordinates.

  • Provide supervision, leadership, training, and work direction for assigned staff.

  • At an advanced level write policies, contracts, speeches, formal presentations, and/or technical and legal documents, correspondence and compose emails in a clear and professional manner.

  • At an advanced level read, analyze, and interpret general business periodicals, professional journals, technical journals and procedures, financial reports, legal documents, and governmental regulations as well as literature, books, reviews, reports, and abstracts.

  • Operate general office equipment to include scanner, printer, copier, telephone, and computer with Microsoft Office Suite.

  • Utilize specialized software and systems to include Map-It, Prolaw, and Westlaw.
