POSITION OVERVIEW:

The Recipient Rights Advisor facilitates the prevention, investigation, education and monitoring of patients' rights within the organization.

FULL-TIME (between 32 and 40 hours per week)

QUALIFICATIONS:

  • Experience: Minimum of two years' experience in the mental health field.
  • Education: Bachelor’s Degree in psychiatry or a related field (preferred).
  • Technical Skills: Experience and training in patient rights, with working knowledge of the Michigan Mental Health Code and Administrative Rules.
  • Other: Will not provide direct patient care.

RESPONSIBILITIES:

Investigation Duties:

  • TheDirector ofRecipientRightsis directly subordinate to the CEO and has unrestricted access to all programs, services, staff, and evidence necessary for conducting investigations or fulfilling monitoring functions.
  • Must be knowledgeable and equipped with the following documents: Michigan Mental Health Code, Administrative Rules, Whistleblowers’ Protection Act, ADA, Michigan Handicapper Civil Rights Act, Elliott-Larsen Civil Rights Act, and other related laws.
  • Receives and investigates complaintsregardingpotential rights violationsin accordance withOffice of Recipient Rights (ORR) standards.
  • Refers confirmed rights violations to the CEO for remedial action and, if unresolved, escalates the matter to the Board of Directors.
  • Informs dissatisfied complainants about the appeal process.

Monitoring Duties:

  • Oversees patient satisfaction programs and ensures confidential case files are securelymaintained.
  • Monitors reports to ensure remedial actions are taken for rights violations, including incidents of abuse, neglect,serious injury, unexpected death, and discrimination.
  • Prepares and presents monthly reports on Recipient Rights issues to the Risk Management/Safety Committee and the Management Team.

Prevention Duties:

  • Regularlyvisitsfacility units to protect recipient rights, providing education on recipient rights to recipients, guardians, and staff.
  • Ensuresthe contact information for the Recipient Rights Advisor is prominently displayed at all service locations.
  • Provides training toTrilliumstaffregardingRecipient Rights within30 daysof employment.
  • Works with Human Resources to ensureappropriate disciplinaryactions are taken in cases of harassment or retaliation related to Recipient Rights activities.

Education:

  • Oversees the development, organization, and implementation of training on recipient rights for employees, contract employees,volunteersor other agents of the agency, within 30 days of hire.When possible, develop training for consumers and family members. Ensure training of the rights advisory andappealscommittee members.
  • Develop and conduct training as required by contract or in response to complaint trends.

TRAINING:

  • Shallreceive annual training.
  • Must attend Basic Skills I and II within 3 months of hire.
  • Must complete Developing Effective Rights Training (DERT) within 3 months of hire.
