Company Description
The Board of Dental Examiners of Alabama is a semi-autonomous Board of the State of Alabama. The Board is comprised of seven members. Six members are licensed dentists, and one member is a licensed dental hygienist. The Board is responsible for the administration and enforcement of the laws and administrative regulations governing the practice of dentistry and dental hygiene in Alabama. The responsibilities of the Board include the examination, licensure, and registration of applicants whom it finds to be qualified to practice dentistry and dental hygiene; the presentation of the Alabama Dental Hygiene Program (“ADHP”), an accelerated certificate Program; efforts to ensure that all licensees are in compliance with the Dental Practice Act (Code of Alabama (1975) § 34-9-1, et seq.) and relevant portions of permanent administrative regulations; the authority to make, amend, and adopt reasonable rules and regulations governing the conduct of dentists, dental hygienists, and other dental auxiliaries; and the obligation to undertake, when appropriate, adjudicatory proceedings and disciplinary action against licensees.
The Board Attorney is a staff member reporting to the Executive Director and the Board. The Board Attorney is a contract position.
Role Description
The Board Attorney will provide legal counsel and representation to the Board of Dental Examiners of Alabama.
Responsibilities:
• Legal advisor to the President of the Board, the Executive Director, the Board of Dental Examiners, and Director of the Alabama Impaired Dental Professional Committee relating to the interpretation of State law governing the licensing and disciplining of dentists and dental hygienists licensed to practice dentistry and dental hygiene in Alabama
• Legal advisor to the Executive Director and investigative staff on conduct of investigations by the Board; legal advisor to other staff on miscellaneous Board-related issues which arise
• Participates in each case review team for every complaint that is accepted for Board investigation
• Prepares hearing notices, subpoenas and other legal documents related to hearings before the Board.
• Prepares administrative complaints and participates as attorney for the Board in hearings.
• Negotiates settlements and prepares documents related to same for certain contested cases in conjunction with the team leader and the Board members.
• Research and reviews proposed legislation sponsored by the Board or any other legislation that affects the Board
• Research federal law as it pertains to Alabama state law.
• Reviews, prepares and interprets rules and regulations of the Board and implements the requirements of the Alabama Administrative Procedure Act for the Board.
• Presents lectures to licensees and permit holders statewide regarding the Dental Practice Act and Regulations of the Board.
• Works in conjunction with the Board’s General Counsel on legal matters relating to the Board
• Performs other duties assigned by the Executive Director or the Board.
• Serves on the Complaint Review Team.
• Advises the Board regarding Robert’s Rules of Order in the Board meeting.
• Attends all Board meetings.
Qualifications
- Demonstrated expertise in Law, including regulatory and administrative law
- Knowledge of Labor and Employment Law to address workforce-related legal matters
- Proficiency in providing Legal Advice and consultation in complex scenarios
- Skilled in Research and analysis of legal precedents, statutes, and regulatory requirements
- Strong Negotiation skills for resolving disputes and reaching agreements
- Exceptional communication and analytical thinking skills
- Juris Doctor (JD) degree and current license to practice law in the State of Alabama
- Experience in governmental or regulatory agencies is a plus
