Position Summary
The Director of Compliance is responsible for overseeing all regulatory, fiduciary, and operational compliance requirements related to 401(k) plan administration, financial services, data security, and enterprise risk. This leader will build and mature the compliance framework, partner cross-functionally with executive leadership, and ensure adherence to ERISA, IRS, DOL, SEC, and financial-industry best practices. The ideal candidate is both a strategic thinker and a hands-on executor who thrives in a fast-paced, high-growth fintech environment.
What You’ll Be Doing:
Regulatory Leadership
- Serve as the company’s primary subject-matter expert on ERISA, DOL regulations, IRS rules, and other laws governing qualified retirement plans.
- Monitor regulatory changes and emerging industry trends, advising executive leadership on impact and necessary actions.
- Oversee all regulatory reporting requirements, including Form 5500 filings, plan-level disclosures, operational compliance testing, and audit readiness.
Compliance Program Ownership
- Build, implement, and maintain the company’s comprehensive compliance framework, policies, and internal controls.
- Lead risk assessments, manage remediation activities, and ensure compliance issues are resolved promptly.
- Develop processes for ongoing monitoring of plan operations, vendor activities, data management, and customer interactions.
Product & Operational Compliance
- Partner with Product, Engineering, Operations, and Customer Support to embed compliance requirements into product design, automation, and plan administration workflows.
- Review and approve product changes, marketing materials, and customer communications for regulatory alignment.
- Ensure all automated plan-administration processes meet regulatory and fiduciary standards.
External Audits & Examinations
- Serve as point of contact for external auditors, regulators, and legal counsel.
- Manage DOL, IRS, or other regulatory examinations, ensuring timely and complete responses.
Leadership & Cross-Functional Collaboration
- Build and lead a small but high-impact compliance team as the business scales.
- Provide compliance training and education company-wide, ensuring consistent understanding of requirements.
- Collaborate with the executive team to align compliance strategy with organizational objectives.
What You Bring:
- 8 years of experience in compliance, legal, or regulatory roles within financial services, retirement plan administration, or fintech.
- Deep expertise in ERISA, IRS retirement plan regulations, and DOL compliance.
- Experience working with (or overseeing) plan administration for 401(k), 403(b), or other qualified plans.
- Proven ability to develop and scale compliance programs in a fast-paced environment.
- Strong communication skills with the ability to influence senior leadership and simplify complex regulations.
Preferred Qualifications
- Experience in a startup or high-growth fintech environment.
- Prior leadership of compliance functions at a recordkeeper, TPA, RIA, or financial technology company.
- Certifications such as QKA, QPA, ARA, APA or similar.
- Familiarity with SOC audits, cybersecurity compliance, and data privacy regulations.
