Curative is Hiring a Remote General Counsel

The General Counsel will oversee Curative’s legal and compliance teams and assist with setting, influencing and implementing the overall strategic direction of the legal and compliance functions for the company. You are a solutions-oriented advisor, who thrives in a fast-paced environment and can partner with executive leaders on all aspects of the business. You will be a trusted advisor and will manage Curative’s current and future risks. This role reports to the CFO.

You will be expected to:

  • Oversee legal, regulatory and compliance matters that impact Curative’s current and future business
  • Counsel our executives, other leaders, and teams in strategic and tactical legal, regulatory, and risk management matters
  • Manage the overall legal and compliance functions
  • Lead a team of 8-10 and provide structure, mentoring and hire when required
  • Provide advice and counsel on state and federal laws regulating the delivery of health insurance services
  • Provide up-to-date subject matter expertise beyond contracting, e.g., on employment, fundraising, corporate, regulatory, and other matters
  • Serve as liaison with outside counsel activities on active litigation, legal and regulatory matters
  • Closely collaborate with the compliance and finance teams on compliance, regulatory, and corporate matters, including but not limited to HIPAA, the Patient Safety Act of 2005, and other healthcare-specific laws and regulatory frameworks
  • Independently own the contracting process and the drafting, revising, and negotiating of contractual agreements that enable Curative to achieve its business goals while protecting its interests and mitigating risk. 
  • Advocate and drive reasonable and effective risk management across the organization, especially regarding privacy and security
  • Perform other duties and contribute to additional initiatives/projects, as deemed appropriate by the management team (it's a startup, after all!)

Requirements

  • J.D. from an ABA-accredited law school
  • Law license in good standing and the ability to register as In-House Counsel.
  • 10 years of relevant experience at a law firm and/or in-house, ideally in healthcare or insurance practice, with knowledge of healthcare technology
  • Expert and well-versed in healthcare and insurance law
  • Familiarity with HIPAA and other data protection privacy laws, federal and state statutes including Centers for Medicare and Medicaid (CMS) rules and regulations
  • Broad legal skillset with adaptability across a range of subject matters, including healthcare, insurance, commercial transactions, litigation, regulatory and compliance.
  • Experience in contracting with providers and payors, including general knowledge of the healthcare and insurance industry dynamics
  • Experience negotiating licensing and/or distribution arrangements, and other types of complex contractual arrangements between related and unrelated business entities a plus
  • Excellent judgment and analytical skills
  • Heightened level of attention to detail
  • A demonstrated track record in developing and leading a team to successfully:
    • Counsel senior executives
    • Structure contracts and think through legal provisions holistically, pragmatically and creatively to meet business objectives
    • Anticipate legal issues and/or risks and "see around the corner"
    • Drive multiple initiatives & processes simultaneously at high quality
    • Coordinate across stakeholders in multiple departments
  • Experience successfully operating with some ambiguity
  • Adaptable to work in a fast-paced and ever-changing start-up environment
  • High professional ethics and integrity
