Cottonwood Financial is Hiring a Chief Compliance Officer Near Irving, TX

Job Description

Reporting to our Chief Executive Officer (CEO), you will manage a team of experienced compliance professionals and be responsible for our overall compliance strategy, with a focus on the oversight and continuous improvement of the Compliance Management System (CMS) that maintains the compliance framework for the company. This hands-on leadership position is a key member of our executive management team. You will be both a strategic and tactical partner to other company leaders as we continue to grow our online (digital) and brick-and-mortar lending footprints with an innovative mix of FinTech products and services. As our Chief Compliance Officer, you will have the flexibility of a hybrid work schedule, working remotely from your home office in the Dallas-Fort Worth area and on-site at our Administrative Office (HQ) in Irving (Las Colinas), TX.

Key Responsibilities

  • Regulatory Compliance
    • Continuously improve our Compliance Management System
    • Interpret and respond to developments in state and federal legislatures
    • Possess or develop deep understanding of Federal Truth in Lending Laws, ECOA, and FDCPA as they pertain to the company’s business
    • Serve as the in-house expert on all federal/state regulations and laws
    • Facilitate the flow of information between company personnel and regulatory agencies
    • Monitor legislative and regulatory developments impacting business strategies, practices and polices
    • Analyze, interpret, summarize, and communicate the impact of proposed laws and regulations to senior management
  • Compliance Policies and Procedures
    • Ensure that our policies and procedures maintain compliance with state and federal consumer financial laws
    • Lead projects spanning various lines of business to implement compliance controls
    • Continuously improve our licensing requirements and procedures
    • Manage our complaint policy and complaint management processes
    • Spearhead updates of policies and procedures to reflect learnings from internal and external audits
    • Research legislation and rules to design and implement compliance policies, procedures, and controls necessary to comply
    • Assess revisions to regulations, identify impact on policies, and communicate updates to senior management
  • Compliance Risk Assessments
    • Design and enhance risk assessments to evaluate the impact of controls on the inherent risk of federal and state consumer financial protection laws and regulations
    • Boost the development of protocols and automation to monitor compliance controls
    • Enhance the compliance of vendor management and vendor onboarding
  • Compliance Audits
    • Execute regulatory audits to ensure compliance with state and federal consumer financial laws
    • Act as a point of contact and direct the gathering documentation for external auditors
    • Manage the development of audit reports and present any findings to members of the Compliance Committee
    • Champion the remediation of any audit findings by partnering with department heads
  • Product Development Compliance
    • Validate implementation of compliance guidelines through user acceptance testing
    • Ensure that the company’s products and services are compliant with all applicable laws and rules at the federal, state, and local level
    • Provide compliance guidelines to the design and development of physical and digital consumer financial products
    • Implement guidelines by working with leaders from various lines of business
    • Ensure marketing material is in compliance with state and federal regulations

Required Qualifications

  • Bachelor’s degree
  • 10 years of regulatory compliance experience in financial services or banking
  • 5 years managing compliance department staff
  • Experience managing both state and federal (CFPB) audits
  • Knowledge of TCPA, UDAAP, E-SIGN, NACHA, FDCPA, Reg B, Reg E, EFTA, SCRA, MLA, TILA and other federal consumer financial protection laws
  • Detail oriented with the ability to identify potential compliance related risks through compliance oversight activities
  • Current Compliance Certification (CRCM or CAMS)
  • Strong written and verbal communication skills
  • Excellent project management and organizational skills with the ability to drive results with a high sense of urgency
  • Working knowledge of Microsoft Office, Teams, and SharePoint
  • Local (Dallas/Fort Worth area) candidates only – no relocation
  • Must be currently authorized to work in the United States without sponsorship and not require sponsorship in the future

Preferred Qualifications

  • Master’s degree or Juris Doctor (J.D.)
  • 3 years’ experience developing compliance guidelines for short term consumer credit products
  • Working knowledge of regulations related to open line of credit products
  • FinTech (online/digital) lending experience
